DRAFT OF LETTER TO SALES TO: FROM: SUBJECT: OSHA Regulations Regarding Asbestos In Joint Compounds May 25, 1976 PLAINTIFF'S EXHIBIT We are currently manufacturing joint compounds with and without asbestos fiber. For those products which contain asbestos we comply with the OSHA regulations regarding the use of asbestos. These regulations include `kJuL level of asbestos fiber in the air at our plant locations. For the past two years we have been making measurements of the asbestos in the air at each plant location. The measurements are in fibers per cubic centimeter of air. The present OSHA regulation calls for a maximum of five fibers/cc and this will be reduced to two fibers/cc on July 1, 1976. Our bi-annual measurements show that we are well below the new standard of two fibers/cc. Also, we comply with all of the other OSHA requirements such as product identification, housekeeping, etc. These OSHA regulations cover manufacturing plants only. There are no regulations governing jobs on construction sites. We have received reports that OSHA inspectors have said that our products cannot be used on jobs and that competitive salesmen are claiming that our product is illegal. These statements are totally false and cannot be substantiated. There was also a report that OSHA has a maximum requirement for the amount of asbestos a product can contain. This is also false. Apparently these reports come from misinformed OSHA inspectors and competitive sales people. Incidents where these false claims hurt our sales should be reported to 0. E. Burch and include the customer or job involved, the name of the individual who made the statement and any other circumstances that may be pertinent.
