In order to provide regulatory certainty, EPA and the Department o f the Army have sent a proposed rule to the Office of Management and Budget for interagency review that would amend the effective date associated with the 2015 Clean Water Rule to give the agencies time to consider the two-step process proposing to rescind and revise the 2015 rule. Background The 2015 rule, which redefined the scope of where the Clean Water Act applies, had an effective date of August 28, 2015. Implementation of the 2015 rule is currently on hold as a result of the Sixth Circuit's nationwide stay of the rule. The 2015 rule is also stayed in 13 states due to a District of North Dakota court ruling. EPA and the Army are taking this action to provide certainty and consistency to the regulated community.
