Jennifer Heindl <jennifer.heindl@sol.doi.gov> Leila, We have determined that there is no legal objection under the ethics statutes and regulations, or the administration's Ethics Pledge, to the Acting Secretary accepting a conference call with Don Cook, Moffat County Commissioner Ray Beck, Moffat County Commissioner Donald Broom, Moffat County Commissioner Jeff Comstock, Natural Resources Director, Moffat County Mike Samson, Garfield County Commissioner John Martin, Garfield County Commissioner Tom Jankovsky, Garfield County Commissioner. Moffat and Garfield Counties are two of the 64 counties within the State of Colorado. They have an interest in the application of Federal greater sage grouse protections and BLM's inventory of Lands with Wilderness Characteristices within their Counties and the State of Colorado. D0l_00011511_00003356 Official Meeting and Nexus to DOI Mission - It is our understanding that the purpose of the conference call is to discuss a proposal from Moffat and Garfield Counties regarding greater sage grouse protections and the development of fluid minerals under priory habitat, as well as the need for Interior to have BLM inventory roads within Lands with Wilderness Characteristics. The nexus between the DOI mission and those of the Counties allows this to be categorized as an official meeting for the Acting Secretary. While we defer to the preferences of the Acting Secretary, given the topics identified for discussion, it may be helpful to include on the phone call appropriate subject matter experts from the DOI that are responsible for these areas. Other Attendees - If any additional parties external to the DOI are added to the list of expected participants, please let us know so that we can make a determination with respect to the new expected participant(s). Ethics Recusal - None of the participants, nor the organizations they represent, is on the Acting Secretary's recusal list. Also, it does not appear that the phone call would include discussion of any particular matter involving a specific party or parties in which Brownstein Hyatt Farber and Schreck (BHFS) or any of the Acting Secretary's former clients under paragraph 6 of the Pledge is or represents a party. If, during the phone call, it becomes apparent that BHFS or any of the Acting Secretary's former clients under paragraph 6 of the Pledge is or represents a party to a matter under discussion, discussion of that matter must cease. Non-Public Information and Party Matters - Consistent with prior advice, the Acting Secretary must refrain from disclosing non-public information during this phone call (5 C.F.R. 2635.703) and should refrain from discussing or making any commitments about any particular matters involving specific parties, such as: litigation, contracts, leases, permits, etc. No Endorsement - The Acting Secretary may not use his official position or title or any authority associated with his public office to endorse the Counties or their representatives; or any product, service, or enterprise. No Partisan Political Activity - While he may discuss the Administration's policy priorities and ideological approach to proposed laws and regulations during this phone call, the Acting Secretary must strictly avoid partisan political activity in order to remain in compliance with the Hatch Act. This is the proposal Moffat and Garfield County made prior to the Government Shutdown, and has never since been addressed. If there is a couple minutes toward the end of our phone call , we would like to address the need for Interior to have BLM inventory roads within Lands with Wilderness Character ( LWC's). BLM has not acknowledged the existence of roads within LWC's and a 12 year statute of limitations is fast approaching, with no intent to address the problem.
