Dear Mr. Stevenson: Subject Container, #QOLU-452101-0, was loaded at Calidria Corporation, King City, CA on January 2, 1985 with 750-50 lb. bags of "Calidria'1 Asbestos Short Fiber Product. This container, destined for Nagoya, Japan via Oak land was sealed with Seal #0001830 before it left the plant property. The Bill of Lading for the above shipment was No. 11010201 (see Attachment I). Please note under "Description of Articles" that our material is des cribed as "Asbestos Shorts or Waste, Testing not over 0-0-8-8". This Is a motor freight classification description (see Attachment II) which has been used for many years to describe the shortest asbestos fiber shipped from Canada. These Canadian short fibers, because of low quality and value, were originally called.refuse or waste unless a customer was found for them. Obviously when they are sold to a customer they are not a waste to be dis carded (see Attachment III). Our asbestos is all short fiber, therefore, our shipments are made under the same freight classification; and, we have used the same description for over 20 years. Effective immediately we will use only the words "asbestos shorts" to describe our material on shipping documents.

Also, we are shipping, asbestos in full compliance with DOT regulations, which do not define asbestos as a haz ardous material to require placarding, etc. I am not aware of any state regulations governing the shipment of asbestos ore or product. 66240. Working Face. "Working face" means that portion of a disposal site where waste is dis
charged and compacted prior to placement of cover material.
Article 2. Scope
66300. Applicability.
(a) Except as provided in Section 66300(b), 66300(g), 66305, or 66310, all
provisions of this chapter shall apply to the management of any liquid, semisol
id, solid, or gaseous waste which conforms to the definition of hazardous waste
in Section 25117 of the Health and Safety Code including but not limited to the .

(1) Waste which is hazardous pursuant to any criterion in Article 11 of this
chapter and consists of or contains a hazardous material cited in Article 9 this
chapter, or is a hazardous sludge, residue, concentrate, leachate or.ash' originat

(2) A waste mixture formed by mixing any waste or substance with a hazard
ous waste.
(3) Hazardous material disposed of to land or water, accidentally discharged
onto land or water, or accidentally spilled onto land or water.
