I. Introduction
On July 13, 2022, an inspection team composed of staff from the U.S. Environmental Protection Agency (EPA) Region III (hereinafter, "EPA Inspection Team") and representatives of the Pennsylvania Department of Environmental Protection (PA DEP) and Carbon County Conservation District (CCCD) met with Bob Colemen at the Lakeview Estates in Towamensing Pennsylvania. The development is approximately 40-acres with 24 lots to be developed. At the time of the inspection, most of the lots were constructed but approximately five had active construction on-going.
A. Inspection Opening Conference
The EPA Inspection Team arrived at the site at approximately 10:00 AM for the announced inspection. The EPA Inspection Team met several representatives of PA DEP, CCCD and representatives of Lakeview Estates. The EPA, PA DEP and CCCD representatives listed below were present at the onset of the inspection:

B. Weather and Precipitation Conditions
During the inspection, weather was clear. National Oceanic and Atmospheric Administration (NOAA) National Weather Service precipitation data for the date of the inspection and 5 days prior are provided in Table 2 below:

C. Summary of the Site/Facility
The total area of the property is 40 acres according to discussions with development representatives. There were 24 lots in the development. Most have already been completed at the time of the inspection and approximately 5 parcels were actively being developed.
II. Site/Facility Activity
The property is a residential development in Towamensing Township, Carbon County Pennsylvania. There was construction activity at several lots during the inspection.
Photographs were taken by Michael Greenwald. The photographs for this report have been processed in order to assign to each photo the original camera-generated file name (e.g., IMAG0032). The camera-generated file name is used to identify each photo in the main narrative of this inspection report. Unused photos are digitally stored and maintained in the inspection file. Unused photos are available upon request.
III. Observations
The following section summarizes the EPA Inspection Team's observations relative to the inspection of the development. The facility is permitted under the NPDES program and there were both construction and post construction requirements included in the permit. Most of the lots were developed and construction was completed at the time of the inspection. The EPA Inspection Team looked at the controls in the active construction sites and the developed parcels. The EPA Inspection Team conducted the inspection from the shared roadway and did not traverse on any individual parcels.
Implementation of Stormwater Controls Part C.3.a of the Permit states "Unless otherwise authorized by the Department or conservation district after consultation with the Department, earth disturbance activities shall be planned and implemented to the extent practicable in accordance with the following: (1) Minimize the extent and duration of earth disturbance. (2) Maximize protection of existing drainage features and vegetation. (3) Minimize soil compaction. (4) Utilize other measures or controls that prevent or minimize the generation of increased stormwater runoff."
Observation #1: At the time of the inspection many of the active construction sites appeared to lack stormwater perimeter controls. Photographs P7130001, P7130002, P7130010, P7130030, P7130039 and P7130043 document the conditions observed during the inspection.
Implementation of Postconstruction Stormwater Controls Part C.6.a of the permit states "The management of post construction stormwater shall be planned and conducted to the extent practicable in accordance with the following: (1) Preserve the integrity of stream channels and maintain and protect the physical, biological, and chemical qualities of the receiving stream. (2) Prevent an increase in the rate of stormwater runoff. (3) Minimize any increase in stormwater runoff volume. (4) Minimize impervious areas. (5)

Maximize the protection of existing drainage features and existing vegetation. (6) Minimize land clearing and grading."
Observation #2: At the time of the inspection, much of the drainage swale appeared to be unvegetated and unstabilized. Materials, potentially concrete washout were observed in the swale during the inspection. Photographs P7130010, P7130027, P7130049, P7130050, P7130051, P7130052, P7130064, P7130065 and P7130066 document the conditions observed during the inspection.
Infiltration Berms Appendix A.2 of the permit states "Twenty-one (21) "Infiltration Berm" BMP's have been proposed as part of the PCSM plan. Please be advised that these BMP's shall be installed as part of individual lot development for all remaining parcels."
Observation #3: Justin Dresh of PA DEP provided the EPA Inspection Team with a map of the proposed Infiltration Berms (Attachment C). PA DEP and EPA representatives walked the site together looking for the Infiltration Berms during the inspection. Many of the Infiltration Berms were identified during the inspection. At the time of the inspection, the EPA Inspection Team was unable to verify Infiltration Berms at parcels 22 or 23. Photographs P7130014 and P7130019 document the parcels. The Infiltration Berm Map is included in Attachment C.
Reforestation Appendix A.1 of the permit states "The proposed BMP "Re-Vegetate/Re-Forest Part 2" has been proposed as part of the OCSM plan and includes the planting of sixty-nine (69) deciduous trees on the project site. Please be advised that these trees shall be installed by the applicant no later than six (6) months from the date or issuance of this permit."
Observation #4: PA DEP and EPA representatives walked the site together looking for the 69 trees that were to be planted. The Inspection Team was informed by development representatives that these trees would be able to be identified by the stakes around them. Development representatives informed the Inspection Team that sometimes these trees were taken down with the development of new parcels. The Inspection Team was able to document tree plantings but was unable to verify at the time of inspection if all 69 trees had been planted.
IV.Records Review The Inspection Team reviewed the permit and Infiltration Berm Map for this inspection.
