ASBESTOS STUDY CO:tl!'!ITTEE REPORT ~ir. Drislane read the report for the Chairman, nr. I. H. Heaver. Please refer to Exhibit 9 Hr. Heaver's report expressed concern on the accusations that have been pressed against the industry concerning the asbestos standards. He revie~.Yed some of the activities of the regulatory agencies over the past year. The last four paragraphs in ~rr. 1~eaver's report aroused some controversy. One director suggested that the last four paragraphs be deleted. There is a serious question as to Hhether the OSHA 2 fiber per cc limit (uhich is to be effective July 1, 1976) can be met by friction material manufacturers. irr. 1~eaver indicated in his report that installers of friction material are now coming under the surveillance of Dr. Selikoff and other proponents of stronger regulation. Several members brought up the point that even uith the regulations there is a s;reat difficulty in getting labor to help in compliance. Even 'IYhen it is written into the lar:Y and instructions are placed in the Hork place the Horking people do not cooperate. Counsel \7as questioned as to the contents of this report 1-1here lfr. lJeaver indicated that he did not see any justification for a change in the attitude of the regulatory agencies. It >vas stated that this 'I.Yas llr. Heaver's viewpoint. Legal Counsel stated that this is not a legal matter and does not expose the Institute. It '7as questioned :vhether sections of this report as written could in any uay harm the Institute. Legal Counsel indicated that this Has not the case. At the llarch 13, 1975 !teeting of the Board of Directors the Secretary \-las advised to contact the Asbestos Information Association (AlA) Hith the idea of discussing possible financial assistance to the Association. !1r. Drislane Hrote lir. ::ereness, Secretary of AIA after the meetinr: and had just received a reply. In Hr. Hereness' reply he indicated his appreciation and that of his Executive Committee for the offer by the Institute. Iim1ever, the Associa.tion felt the best ,;ay to support t'ne AlA 'lvas by individual members becoming members of the Asbestos Information Association. He indicated the ~eneral fee structure for mem~ership in the AlA, '!r. Hoalli stated that the AlA ,;ras of great help to our industry. He indicated that D.aybestos Has considering a survey on the health history of 'vorkers in one of their plants. They, as an individual company Here sponsoring and paying for a survey ~zhich could be a help to all industry. He indicated that it \vould be better if industry participated in the activities of the Asbestos Information Association to support similar types of \'lork. Drislane displayed sone posters that had been sent by !1r. Hereness of the .wbestos Information ~ssociation. These posters had been received at lnnisbrook. These posters had hir.ts such as "If you don't snake nmr, don't start. If you do snoke quit." and"Vacuun dust spills--never dry sweep." There uere others to help deliver the Harnin~ to Harkers concerning the asbestos dust problem. A point that has been raised several times is that the \.Yorkers should be advised of the seriousness of the problem. These posters are an assist in getting this messa~;P. across. It 1.ras suggested that participation in the Asbestos Information l\.ssociation as members 1muld help friction materials manufacturers Hith the asoestos problem. The Secretary uas advised to send a copy of Hr. ~1ercness letter of June 12, 1975 to the membership, indicating the AlA's invitation to have them join their association. At this point it was stated that the Asbestos Study Committee had passed a resolution as folloHs: "That the Co!lUDittee requests guidance from the Board of Directors col".cerning the prohlem of the t1o fiber/cc limit and the lack of reliabtli ty of the 1:ter:1hrane filter method for J'leasurel'lent of fiber counts.,. 7!1e Asbestos Stu.dy Cor.unittee members Here concerned that 11hile the ll\en'urane filter technique is the only method now available for neasuring asbestos concentrations it is a most unreliable tool for enforce!'l.ent of the two fibers/cc limit. In searchin~ for cuidance for the Committee one Director stated that our objection to u::c of t;1is :1cthod for enforcement 1-10uld not be constructive. It 'imuld~just stir ~:atters up !ithout providi!!g an alternative. Some rer,ulatory authorities are receptive uhcre suggestions are made for improvement. Simply indicatinc our dissatisfaction -:lith the meubrane filter method for enforcement mipht be considered as a negative attitude. A Director stated that the hyeienists ~rill use common sense and realize the fallibility of the membrane filter technique. It is fairly well l~noFn in industry and sovernnent that t~1is technique is fallible. Hhile the directors expressed ~oncern over the usc of this as an enforcement tool, they do not feel that any Institute position should be expressed to JSI1A concernins its use. It T,Jas felt that those enforcing the OSH/'""' relations are a111are of the disparity in results using this technique. He said that his asbestos association Chambre Syndicale de 1' Ar.ri.ante (France), had an expert 1-10rkinc for the association in the sampl:ing and countinc; area. This movie had intervie'ivS ldth Jrs .llolnes an.:Lewinsohn .. of TBA, and Dr. Selikoff of l-1ount Sinai. They discussed data on \-J"orl:ers .done several years aro that resulted in the 2 fibers/cc limit. A More recent revie:l of data by Dr. Lvwinsohn indicated to Dr. Selikoff that the 2 fibers /cc limit mizht not be satisfactory. The controversy betHeen Dr. Selikoff and Dr. Leuinsoha 'Tas shmm in this film. 'i'he areument centered on interpretation of the statistics. It lJas rec0111mended that the movie be shown to the membership. FMSI 07368 ------- , ' Yiinutes of the Heeting of the Board of Directors - 12 - June 17, 1975 The Secretary brought up for discussion the fact that a CongresS't>Toman from New Jersey (llrs. Hillicent Fenwick) has proposed legislation for the sale of Chrysotile asbestos from the national stockpile. Some individual asbestos users and the Asbestos Information Association supported Urs. Femv-ick in this leeislation. The purpose of the legislation is to help industry reduce unemployment brought on by the asbestos shortage. The number of tons that might be released is about 10,000. It is not felt that this is really significant but in any case its release cannot hurt. The Secretary vTas directed to ,.,rite a letter to Nrs. Fenvrick in support of this legislation. A!HIUAL MEETING COHHITTEE Hr. Drislane read the report for the Chairman of the Annual lleeting Committee, lrr. Barton. See Exhibit 14. In summary, the report recommended a return to Innisbrook in June 1976, and if that was not satisfactory, the Phoenix-Scottsdale area. Upon motion duly made, seconded and unanimously passed it was RESOLVED: That the report of the Annual iieeting Committee be accepted as 11ritten. HISTORICAL SALES REPORTING The Secretary read a report on Historical Sales t>Thich is Exhibit 13. In essence, participation t>Tas good rith 15 of 19 members reporting. The reporting has been moved to a quarterly basis as of Ilarch 31, 1975. (This t.ms decided at the Board of Directors lleeting on Harch 13, 1975). Immediately prior to the meeting, the accountants advised that the !iarch 31 report was ready and would be distributed to the membership. At this point, the subject of listing those reporting in each category was brought up. At the present time, the names of the companies reporting in at least one category are listed at the bottom of the report, and the number of companies (but not the names) report;ng in each particular category also is listed, e.g., X number of members reported brake linings, Y number of members reported brake blocks, etc. It had been suggested that the names of the members reportin~ in each of these categories also be listed, so that the composite sales figures in each category tlill be more meaningful. The objection to listing the members reporting in each category is that the Institute must be careful if sales data is passed out to members. It is apparent that if only two members were reporting in a category one member ~rould know the quantitien of the other reporting member. At a level of three reporting, one might get a pretty good handle. At four and above the data probably could not be broken down to individual members. Legal Counsel was queried concerning this problem. He indicated that there should be no problem if at least four tv-ere reporting in each cntegory. Upon motion duly made, seconded and unanimously passed it was ~ESOLVED: That the Board of Directors recommends that the Historical Sales Report list the names of those reporting in each category t-1hen there are at least four reporting in that category. (2) Further we have not indicated shoe drillin~ lJhether it uas drum or disc in the past. (3) Further, if the Institute uere to set up numbers based on Aimee's drilling patterns we :tmuld be setting up Aimee as a standard. ?!r. Hoalli felt that if ue were to take such action, it lmuld put Aimee Industries in a position above others ~1ho might decide on drilline for replacenent market shoes. The Directors supported the Data Book and Technical Co~~ttee position of not providin~ F11SI assignments to parts made by a replacement market supplier such as Aimee.
