Mr. Donahue and Ms. Tardif: I am an attorney at Sidley, and we represent the Interstate Natural Gas Association of America (INGAA) and the American Petroleum Institute (API) in connection with the Good Neighbor Rule, including in the ongoing D.C. Circuit litigation and pending request to EPA for reconsideration where we are part of the group of industry stakeholder petitioners. As I'm sure you know, the court recently denied the US motion to hold the Good Neighbor litigation in abeyance, requiring prompt briefing (US filing due March 10) on the supplemental notice on remand that EPA issued at the end of last year and a short timeline for oral argument on the merits (April 25). We would appreciate the opportunity to meet with you to discuss our perspective, particularly our views on the pending requests for reconsideration and how those could potentially address the challenge presented by the court's decision to deny the requested abeyance.
