The inspection occurred for-cause due to suspected distribution or sale of unregistered pesticides. FACILITY DESCRIPTION Supermercado Gigante #2 is a privately owned company doing business in the state of Texas. Supermercado Gigante #2 operates as a gasoline service station and grocery/convenience store. The annual revenue of the company is unknown. Section II - OBSERVATIONS I, Environmental Protection Agency (EPA) Region 6 Inspector, Kiera Hancock, and Inspector Justin Mullenix arrived at Supermercado Gigante #2 on March 24, 2026, and entered the facility at approximately 9:00 AM. We approached the store cashier, Ms. Selena Cazamorano. Inspector Mullenix and I presented our federal credentials and a Notice of Inspection (EPA Form 3540-2) to Ms. Cazamorano and explained the scope of the inspection. Ms. Cazamorano called over another employee and we explained the purpose of the inspection again. The other employee gave permission for the inspection to continue, and Ms. Cazamorano signed the Notice of Inspection (Appendix 2). Inspector Mullenix and I then proceeded to the store aisle where household chemical products were being offered for sale. We reviewed the products for compliance with FIFRA, determining applicability and checking for EPA Registration Numbers and Establishment Numbers. During the product review, we encountered the following Products of Concern: - Clorox Cloro Triple Accin (500mL, 930mL, & 1.89L) - Ariel Doble Poder (1.5Kg) All of the Products of Concern made pesticidal claims and did not have EPA Registration or Establishment Numbers on their labels, indicating an unregistered status with the EPA. All the Products of Concern were photographed (Appendix 1). At the conclusion of the inspection, Inspector Mullenix and I reapproached Ms. Cazamorano and explained our findings, recommending that she remove the Products of Concern from the sales floor immediately until further notification by the EPA. I then prepared a Receipt for Samples (EPA Form 3540-3) for the photographs taken during the inspection and Ms. Cazamorano signed the document. (Appendix 3). Ms. Cazamorano received copies of the Notice of Inspection, Receipt for Samples, EPA Small Business Resources Information Sheet and Confidential Business Information (CBI) notification. The inspection concluded at approximately 9:27 AM. 2 Supermercado Gigante #2 Inspection Date 3/24/2026 Section III - AREAS OF CONCERN An area of concern identified during the inspection is the potential distribution or sale of unregistered pesticides ("Products of Concern") in violation of Section 12(a)(1)(A) of FIFRA. Section IV - FOLLOW UP No additional information has been requested or received by EPA after exiting the facility on March 24, 2026.
