Mr. Herman of Herman & Ernst called at our office yesterday, as per appointment, and one of the matters dis cussed was the above case. We understand that Mr, Spargo has had several conferences with Mr. Herman in the past per taining to this matter and it is, therefore,, suggested that the next time Mr. Spargo is in New York he arrange to call and see Mr. Herman about this matter. The situation very briefly is thfet the City of New York has given notice of intention to deduct approximately $18,000. from the general contractor because of the failure to use paint specified. The contractor has stated that if it is unable to recover the amount, it in turh will proceed against the subcontractor, fuller & Moosman, and unless there is some money coming to Tuiler & Moosman, the prospects for recovery on your account are not very good, as we are given to understand that Tuiler & Moosman have no financial re- sponsibixity. In addition, fuller & Moosman are pressing a counterclaim. Will you kindly let us know If there is a likelihood that Mr. Spargo will be in New York, in the immediate future, and if so, will it be convenient for him to call and see Mr. Herman?
