A miner, while riding an underground motor, suddenly felt like he wanted to cough, and started to spit blood. His condition while at first being diagnosed as pulmonary pneumonia was later established with further examination as pulmonary tuberculosis. Medical testimony showed without appreciable conflict that the claimant did not at any time suffer or incur silicosis. Diagnostic tests revealed that the tuberculosis was of the pneu monic type, uncomplicated by silicos;s, and was hot the result either pri marily or by inducement or aggravation, of an accident arising out of and in the course of his employment by the mining company. Failing to estab lish his claim, the claimant was barred from compensation by the Board. The court upheld a finding that the disability complained of was not a com pensable one, under either the Workmen's Compensation Law, or the Occupational Disease Law. Davis v. Where a worker contracted occupational dermatitis and her recovery depended, according to medical evidence, on an avoidance of mica, as the probable source of the original incidence of the disease, an order for her to return to work where there was a possibility that mica dust would be present would run the risk of exposing the claimant to further infection before she was completely cured and would not be Justified.
