HSC Meeting Minutes February 21, 1990 Page 2
1. R. Van Mynen, chairman, convened the meeting at 9:00 a.m.
2. Minutes
The minutes of the January 17, 1990, meeting were approved as written.
3. Budget
G. Strickland reviewed the budget, noting that the adjusted budget column now reflects expected expenditures for the rest of FY 89/90 and that approximately 1/3 of the budget has been contracted.
4. HAZWOPER
N. Cookson briefed the committee on CMA's intervention in the AFL-CI0 vs. OSHA suit and asked that CMA continue its intervention. The committee agreed.
5. Health Surveillance
H. Eschenbach discussed the health surveillance options handbook development project and asked for approval to spend $45,000 to polish and print the document. The committee approved the expenditure.
6. SARA Section 110/ATSDR
S. Tirey discussed shifts in CMA's strategy for addressing voluntary testing under SARA Section 110 and asked the committee to approve a draft decision framework and model agreement to be sent to ATSDR. The members approved the request and discussed steps to expedite ATSDR's voluntary testing and the need for ATSDR to better coordinate its testing requirements with EPA's TSCA Section 4, and the OECD Existing Chemicals Testing Programs. A revised cover letter to ATSDR will be drafted and circulated to HSC members for approval.
7. Focus Area 1 Workplan: Customers
G. Weckerlln, chairman of the Product Safety Task Group, reviewed the plans, activities and accomplishments under the Focus Area 1 workplan. Product stewardship code drafting activities and the growing interest in indoor air pollution were highlighted. CMA staff were asked to consider ways of increasing the resources applied to the indoor air pollution issue.
8. Risk
J. LeBeau briefly described the progress of the ad hoc Imposed Risk Study Group, and noted that his presentation to the Board of Directors will be rescheduled for June rather than April.

9. OECD Existing Chemicals Program
J. LeBeau reviewed last month's OECD existing chemicals meeting and mentioned that we now have a screening information data set (SIDS) that hopefully will be blessed by the OECD updating panel. He reminded members of the tight deadlines for action, the importance of the voluntary effort and an internationally accepted SIDS. Members who will participate in the pilot test should immediately notify him or Kathy Rosica.
The CMA program will most likely be established as a function of the ad hoc OECD group. The group will be expanded to accommodate a representative for each company participating in the pilot project. Companies will manage their own testing contracts and develop cost-sharing agreements among those who agree to jointly test a chemical.
10. MSDS Guideline Project
J. LeBeau mentioned that member comments on the draft MSDS Guidelines have, for the most part, been very positive. The next step in the project is a research study, with focus groups, that will be conducted as a joint venture with OSHA. CMA will seek OSHA funding for 50% of the $100,000 project. The committee approved expenditures of $50,000 to cover CMA's portion of the study.
11. International Labor Organisation (ILO) Convention/Recommendations
K. Rosica briefed the committee on CMA's proposed policy for the ILO Convention on Safety in the Use of Chemicals at Work. It will be presented to the CMA Executive Committee on March 6, 1990. CMA's comments, in response to OSHA's Federal Register notice on the ILO Convention, are being drafted for submission by March 23rd. The final contents will be circulated to the committee members for review before they are sent to OSHA.
12. TSCA
A.) K. Rosica briefed the committee on major points to be made in a planned meeting of CMA, SOCMA and EPA. The meeting, temporarily postponed, will address possible ways to enhance the TSCA Section A chemical testing program. Members were asked to relay any comments on the draft briefing papers, distributed at the meeting, to Kathy Rosica as soon as possible.
B.) T. O'Leary asked that the comnittee approve the concepts in a draft letter to EPA on changing guidance under TSCA and the Agency's retroactive application of that guidance. Members observed:
CMA 061015
HSC Meeting Minutes February 21, 1990 Page 4
- the language of the letter is somewhat overly legalistic; - the letter over emphasizes the TSCA 8(e) issue while under
emphasizing issues such as PMN salts; - the retrospective application of new guidance would be
better placed at the end of the letter; and if EPA's desire is to gather information, the Agency could facilitate that by providing a period of compliance after a reinterpretation and before enforcement actions.
Following the NRTG's approval of a final draft of the letter, it should be faxed to HSC members for their approval and any final comments.
14. International Union of Pure and Applied Chemistry (IUPAC):
G. Strickland asked for the committee's recommendations on whether the 1991 IUPAC seminar, should be supported by CMA and its members. The members commented that the seminar sounds like a good idea but that CMA has higher priorities for its limited resources.
15. Exposure Assessment
M. Finn discussed a proposed project to analyze the impact of exposure assumptions and asked the committee to approve expenditures of $105,000 to fund the project. The committee approved the request and discussed methods of increasing the value and acceptability of the project by those outside the chemical industry. Reportedly, EPA favors the project and is looking forward to its results.
16. Worker Participation
H. Eschenbach called for additional nominees to form an ad hoc Worker Participation Work Group. Only five companies are now involved in the group. J. Price added that 0RC is also working on the worker participation issue and CMA should work closely with 0RC staff. Several meetings will be held over the six month period beginning March 14, 1990. Names of candidates should be sent to Karen Creedon.
17. New Jersey Help Bill
R. Ondocsin discussed major concerns raised by the New Jersey Hazard Elimination through Local Participation (HELP) Act. The New Jersey CIC is actively responding to the bill with CMA's assistance.

18. Paperwork Reduction Act (PRA) Coalition
T. O'Leary asked that the committee approve expenditures of $1,000 as a CMA contribution to the PRA coalition, which is managing advocacy on reauthorization of the Paperwork Reduction Act. The committee observed that coalition support for advocacy on the Paperwork Reduction Act is outside the committee's charter. However, if the appropriate CMA committee approves supporting the coalition and lacks funds to do so, the Health and Safety Committee will yield $1,000 towards its support. T. O'Leary will inform the committee if another CMA group opts to support the coalition.
19. Sponsor Reports
Committee sponsors briefed the committee on activities, seminars, programs and important future meetings within their assigned areas.
Additionally, J. Price provided an in-depth critique of the Independent Scientist Seminar and recommendations that it be continued, possibly with a focus on risk issues. He also briefed the committee on plans for the HSC Open Meeting, April 17, 1990, and reminded members of the HSC Planning Meeting scheduled for May 7-9, 1990, at the Williamsburg Inn. April 6, 1990, is the deadline for confirming reservations. Details for making reservations will be sent to each member next week.
R. Van Mynen mentioned that the Steering Task Group will propose a change in the full committee's rules to provide for a normal rotation of task group chairpersons. The rule being considered would state that chairpersons can be reappointed for up to three consecutive one year terms. The rule change will be proposed at the March meeting. He also announced that Jim Keith, Dow, will chair the Notification and Reporting Task Group. J. Kasper, the current chairman, has been nominated for membership on the Health and Safety Coosittee.
