Box 3177 Abilene, Texas 79604 ATTN: Agent-in-charge Dear Agent-in-charge: The Occupational Safety and Health Administration (OSHA) received a complaint concerning safety and health hazards at your worksite located 10 miles West of Anson, Texas. The specific nature of the complaint in volves the fact that a material containing asbestos (Super-Vis, manu factured by the Buffalo Mud Company) is mixed into the drilling mud with out the use of respirators and goggles. We have not determined whether hazards, as alleged, exist at your work place, and we are not conducting an inspection at this time. However, since allegations of violations have been made, you should immediately investigate the alleged condition(s) and make necessary corrections or modifications. Within 30 calendar days of receipt of this letter, please advise me in writing of your findings and of the action you have taken. Your response should be detailed, stating specifically what action you have taken to abate any hazards. You should enclose any supporting documentation of the action you have taken such as monitoring results, ordering of equipment, and the like. The complainant has been advised of our response to the complaint and furnished a copy of this letter. Section 11(c) of the Occupational Safety and Health Act of 1970 (Public Law 91-596) provides that, "No person shall discharge or in any manner discriminate against any employee because such employee has filed any complaint or because of the exercise by such employee on behalf of himself or others of any right afforded by this Act." This letter is not a citation, nor is it a notification of proposed penalty, which according to the OSHA Act may only be issued after an' inspection or investigation of the workplace. If we do not receive a response from you within 30 calendar days or less indicating that appropriate action has been taken, an inspection will be conducted. In addition, OSHA's policy is to randomly follow up with an inspection in a sample of cases in vrtiich we receive letters of satisfactory abate ment action from an employer. Finally, any action taken by you in this matter cannot remove your workplace from the possibility of an unan nounced inspection by duly authorized representatives of OSHA. If you have any questions concerning this matter, please contact our office. Area mud companies are evare of our policy and utilize liquid ?1000 in liew of Super-Vis. Hanagement was iot aware that Super-Vis was being used on our Rig $1.- Upon receipt of your letter, we called the operator of the well and advised him of the problem and learned that a company named ChemDrill was the drilling mud contractor. Ive have not previously utilized this company and they were unaware of our policy. The company was directed to pick up the asbestos con taining materials and have done so. Super-Vis is a cheaper material and apparently the mud contractor sought to keep the mud charges lower through its use. If our employee had sinplv called the office and notified us of the problem, the Super-Vis would 'nave Leen eliminated even sooner. We recognize that the Product Liability issue will be the key issue to be addressed at the meeting and discussion on it will go a long way towards providing insight and direction to items d, e, and f. You mentioned that Harry and Allen will be staying overnight in the city and your plans were to return to Tulsa on an American flight leaving at 7:00 P.M., so it looks like we will have about five solid hours to cover issues we need to discuss.
