Troy Stuckey, PhD Date 6ENFORM-019-R8.2 (02/12/2020) 1 Section I - INTRODUCTION Fastco, Inc. / FASTCO Inspection Date 03/06/2024 PURPOSE OF THE INSPECTION This neutral scheme marketplace inspection was conducted pursuant to the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) Section 8, 7 U.S.C. 136f, and Section 9(a), 7 U.S.C. 136g(a), to evaluate compliance with FIFRA and the regulations thereunder. FACILITY DESCRIPTION Fastco, Inc. ("FASTCO") is a company headquartered in Laredo, Texas, that operates as a customs broker. The company operates out of a single location and earns an estimated annual revenue of $1.21 million according to sources available online. Section II - OBSERVATIONS I, EPA Region 6 inspector Justin Mullenix, accompanied by EPA staff members Gerardo Acosta and Christine Tokarz, arrived at FASTCO on March 6, 2024, at approximately 8:50 AM. We entered the facility and identified ourselves to an employee who we then asked if a supervisor was present. We were led to a nearby conference room where we met with Mr. Francisco Reyes, co-owner of the company and U.S. customs broker. I explained the objective of the inspection and asked if the company deals in any pesticidal products. Mr. Reyes confirmed that the company facilitates the import and export of pesticidal products but that none were present at the facility at the time of inspection. Mr. Reyes explained that most of the products that the company distributes are never received by the facility, and those that are received are only in inventory for a matter of days. He went on to explain that he was aware of certain pesticidal products distributed by FASTCO being exported to Mexico for further processing into finished products. I asked Mr. Reyes if any pesticides are produced (formulated, packaged, labeled, re-packaged, re-labeled, etc.) at the FASTCO facility and he stated no. I asked Mr. Reyes if he could provide a tour of the facility and he agreed. Prior to the tour, I presented my federal credential to Mr. Reyes along with a Notice of Inspection (EPA Form 3540-2) which he and I signed. We followed Mr. Reyes to a warehouse portion of the facility where various products were being held in inventory. Mr. Reyes explained that chemicals were kept separate from other products, and we proceeded to that part of the warehouse. I and the accompanying EPA staff members evaluated the chemicals that were present and did not observe any FIFRA-regulated products. After touring the facility, we returned to the conference room. I discussed the outcome of the inspection and provided the Notice of Inspection to Mr. Reyes which he photocopied for his records. I provided a copy of the U.S. EPA Small Business Resources Information Sheet to Mr. Reyes as well and informed him 2 Fastco, Inc. / FASTCO Inspection Date 03/06/2024 that an inspection report would be provided to FASTCO within 60 days. The inspection concluded at approximately 9:20 AM. Section III - AREAS OF CONCERN No areas of concern were observed at the time of inspection.
