Construction Products Division Date: October 18, 1983 Sub j: Cal/OSHA November 17, 1983 Hearing Re "Dusts, Fumes, Mists, Vapors, and Gases" The attached current mailing from Cal/OSHA announces a November 17 public hearing concerning several matters -- one of which, item No. 1 "Dust, Fumes, Mists, Vapors, and Gases" that may have an impact on our customer's operations. For that reason I am forwarding this to you for review, comment, and recommendation concerning further activity by me or others. Although I am not an expert on Cal/OSHA's dust requirements, I did observe judicial hearings connected with Cal/OSHA and one of our M0N0K0TE customers. During those sessions, Cal/OSHA's position (sustained by the judge) was that "mechanical ventiliation", "exhaust systems" etc. were applicable to construction site operations. (Bob Ericson tells me that you have my file on this matter, which I'd appreciate your returning to me.) Although our customer was eventually fined his development of the so-called "M0N0K0TE dust cover" was a positive conclusion. T am less familiar with current Cal/OSHA regulations concerning fumes and vapors, but suspect there may be some applicability to the MSG family of products. Unconnected to the above Cal/OSHA matter, I received a draft of a report "Toxics Management In California". I am also enclosing that draft for your review and comment to the Task Force. TPF/jdy
