( i i ) Cargo spaces or other spaces containing or having la s t contained bulk liq u id or gas cargoes of a poisonous, corrosive, or irritan t nature. ( i i i ) Spaces in tank v e sse ls inznediately above or adjacent to those described in subdivisions ( i ) to ( i i ) of th is subparagraph. ( iv ) Spaces that have been fumigated. (2) I f the atmosphere i s found to contain flammable or explosive vapors in concentrations at or above ten percent of th eir lower explosive lim it , the space sh a ll be ven tilated s u ffic ie n tly to bring the concentration below ten percent o f the lower explosive lim it, and when necessary, the provision of subparagraph ( 6V o f th is paragraph 3hall be applied. B attery-fed, portable lamps bearing the approval of the Underwriters* Laboratories for use in Class I , Group D atmospheres, or approved as perm issible by the U. S. Bureau o f Mines, and such lamps - 5- lia te d by the U. S. Coast Guard as approved fo r such use are deemed to aeet the requirements o f th is paragraph. Explanation To c la r if y the point th a t explosion-proof, battery-fed lamps are required in spaces containing or having contained flamaable liquid only before they are c e r tifie d as safe for fir e . SUBPART C - SURFACE PREPARATION AND PRESERVATION Aaend Section 1501.21 as follow s: D elete paragraphs (c ) and ( d ) , r e le tte r present paragraph (e ) as ( c ) , and amend paragraph ( a ) . 1501.21(a) When to x ic solven ts are used, the employer sh a ll employ one or taore o f the follow ing measures to safeguard the health of employees exposed to these so lv en ts. (1 ) l i e cleaning operation sh a ll be completely enclosed to prevent the escape o f vapor in to the working space. (2) Either natural v e n tila tio n or saechanical exhaust v en tila tio n sh a ll be used to remove the vapor a t the source and to d ilu te the concentration of vapors in the working space to the point at which an unsafe concentration does c o t e x is t . (3 ) Employees sh a ll be protected by su itab le respiratory p rotective equipment in accordance w ith the requirements of Section 1501.82(a) and ( c ) . (b) The p rin cip les in the threshold lin d t values to which a tten tio n i s d irected in Section 1501.5 w ill be used by the Department o f Labor in enforcement proceedings in defining a safe concentration of vapors. ( c ) When floanable solven ts are used, precautions sh a ll be taken in accordance with the requirements of Section 1501.25. The amendment o f th is section i s required by new paragraphs Section 1502.21 - Same as above. Add new Section l501.23(c)(l)(iv) as follows: 1 5 0 1 .2 3 (c )(l)(iv ) A control device sh a ll be -provided at the nozzle end of the b lastin g bos to provide for control of the flo v by the b la s te r , and to provide automatic cu to ff in the event he lo ses control of the hose. Explanation To provide control of th is flow a t the n o zzle. This i s to prevent recurrence o f several accidents that have occurred when the pot tender m isinterpreted a notion o f the b la ste r to mean "turn on the flo v ," which resu lted in badly injuring the b la ste r . In instances when the b laster l o s t control of h is hose i t whipped him and others in the immediate area, which an automatic sh utoff would prevent. Sections 1502.35(g) and 1503.35(g) --Same as above. .Amend Section 1501.36(a)(2) as follow s: 1501.36(a)(2) Any current carrying parts passing through the portion of the holder which the arc welder or cu tter grips in h is hand, and the outer surfaces of the .jaws of the h old er, sh a ll be fu lly insulated against the maximum voltage encountered to ground. Explanation To protect welders from e le c t r ic a l shock from uninsulated jaws of electrode holders and to minimise p o s s ib ilit y of accidental arcing from the exposed p arts. SUBPART E - SCAFFOLDS, LADDERS AND OTHER WOPXIKO SURFACES Amend Section 1501.41(a)(6) as follow s; , 1501.41(a)(6) Barrels, boxes, cans, loose bricks or other unstable objects sh a ll not be used as working platforms or for the support of planking intended as scaffold s or working platforms. Explanation To prohibit the use of the above unstable objects themselves as working platforms. -9- Sections 1502.41(a)(6) and 1503.41(a)(6) - Same as above.
