The inspection was announced the day before the inspection because the farm had ceased swine farming operations and we needed to obtain access permission to inspect the closed yet still permitted farm. We spoke with /owner by telephone on July 12 and 13, 2023 to gain permission to inspect the farm site, but was not present during the inspection. During the phone conversations, I explained to that this was an EPA inspection to determine the facility's site conditions and lagoon management since his closure of the farm. The facility is regulated under the requirements found within the facility's Arkansas Department of Environmental Quality (ADEQ) Regulation No. 5 AFO general permit. As his facility is closed, no review of the Comprehensive Nutrient Management Plan (CNMP) took place. For biosecurity purposes, the inspectors parked the GSA vehicle at the driveway entry, toured the site on foot and wore Tyvek suits and over-boots. There were no other biosecurity or disease issues of concern at the farm. FACILITY DESCRIPTION has a current ADEQ permit effective May 1, 2012. The permit allowed for 960 sows, 4 boars, and 1206 weaner pigs contained within two barns. However, according to , the farm closed approximately two years ago. And, at the time of the EPA site inspection, the farm had six barns instead of the two mentioned in the 2012 ADEQ permit. The two lagoons described within the permit have a combined operational storage capacity of 1,441,237 gallons with 20" of freeboard. Section II - OBSERVATIONS The farm closed and depopulated the swine approximately two years ago, according to . However, the farm did not notify and submit a lagoon closure plan to the ADEQ within 60 days (of the closure) as required by their ADEQ permit, Part II Specific Conditions (paragraph 21). The farm has six empty swine barns and two lagoons, although the ADEQ permit only mentions that the farm has two swine barns. Each lagoon is equipped with a pole marker, and the embankments were mowed and showed no evidence of erosion or a discharge. The north lagoon's pole marker showed that the wastewater level was approximately 3" below the pump-out mark, and the unit had approximately two feet of freeboard. There was a pump located on the embankment with a PTO shaft that would be driven by a tractor. The south lagoon's pole marker showed that the wastewater level was approximately 10" below the pump-out mark and had approximately four feet of freeboard. The embankments of the south lagoon also showed no evidence or erosion or a discharge. 2 Inspection Date 07/13/2023 Section III - AREAS OF CONCERN AOC 1: When the farm closed approximately two years ago, the owner did not submit a closure plan for the lagoons to the ADEQ within the required 60 days of closure as required by their ADEQ permit, Part II Specific Conditions (paragraph 21). This requirement also requires that the owner submits a certification from the NRCS that the lagoons were closed in accordance with NRCS standards. AOC 2: The closed farm has six swine barns while the ADEQ permit only mentioned that there were two swine barns. There is a disconnect between the number of barns that has and what his permit allows. He may have expanded his farm operation without providing for a major permit amendment. However, the farm is now closed as of approximately two years ago.
