The material is shipped by us to Agricultural Chemicals, Inc* in drums in the form of a dry flaked material* The drums bear labels containing adequate warnings and precautions for use as required under the Federal Insecticide Act. Millions of pounds of this material have been produced, shipped, ground, mixed and dusted on agricultural crops without reported injuries to personnel handling it. Attention* Chemical Department Gentlemen* We represent the Houston Fire and Casualty Insurance Company and are investigating a compensation claim wherein the claimant alleges that while handling some fiber drums which had contained benzene hexaehloride, the claimant received injury to his lungs. We would appreciate very much your furnishing us with the chemical mixture of the benzene hexaehloride in order that we might give this information to the examining physician to determine whether the claimant's injury was actually caused by such chemicals. For your further information, it was not in the use of your product which the claimant alleges injury, it was while employed by our assured who had purchased the empty drums from the Agricultural Chemicals, Inc. of Llano, Texas, and had delivered them to Wichita Falls, and while in the process of unloading the empty drums, the claimant alleges the injury.
