Dear Chris:
As we discussed last week, I believe Sherwin-Williams is entitled to
additional monies as reimbursement for indemnity benefits paid by the company's Long Term Disability plan.
The claimant's temporary total disability payments from August 21, 1990 thru
February 28, 1992 were made at $127.95. The company's LTD plan paid monies to the claimant during this period as well, in the amount of $2,043.25 per month, or $486.48 per week. Since the claimant's temporary total disability rate was established at $387.76, Sherwin-Williams should be entitled to the difference, $259.81 ($387.76 less $127.95).
The check in the amount of $22,249.97, covered the period September 8, 1990 thru February 28, 1992. I determined this period amounts to 116 weeks, and thus, this reimbursement was paid at $191.80 per week. Sherwin-Williams should receive the difference between the $259.81 and $191.80 for the entire
116 week period. According to ay calculations, the weekly amount due is $68.01, or $7,889.16 for the entire period.
