We have also been advised that OSHA has granted UCC an interpretation of the OSHA standard ruling that on all resins sold to customers who make products made wholly or partly from FVC which does not require further processing at temperatures and for times suf ficient to cause mass melting of the PVC the regulation does not apply. We bell ve our Latex, Solvent and Dispersion resin customers meet this requirement and, therefore, we are considering all Latex ana all packaged Solvent and Dispersion resins to be exempt from the conditions set forth in the regulation. Because of their inter changeability, all bulk vehicles used in the shipments of vinyls (hopper cars,Jaopper trucks and vans) will be labeled even though they may at times be used for the ship ment of the exempt vinyl resin products. ' 1 Because of the above conditions, you are to proceed immediately to label as follows: 1. All monomer cars at South Charleston shall have the DOT placard modified, if full to include vinyl chloride in 3A" letters and under it Cancer Suspect Agent in 1/2" letters. If the car is empty, the return side should be out with the same legend in 5/l6" and 3/16" respectively. .2 All vinyl vans shall be labeled using the 6005-2 label (l/4" letters), oneabove each unloading port and one on the 20" man cover. 3* All vinyl hopper cars shall be labeled using 6005-1 on each hatch and either the 6005-1 label or the 6005-4 tag (3/8" letters) on or in the vicinity of each out- let. A total of 16 per car. -**?f*' 4. All hopper trucks shall contain at shipment a 6005-1 label or 6005-4 tag (3/8" letters) on each hatch and each outlet. 5. All suspension and non-solvent resin in inventory, list attached, shall contain on two sides of each pallet a 6005-4 label (3/4" print). At least one label must be in contact with bottom row of bags next to pallet so pallet will be identified at customer's plant until fully consumed. , * ' `'i S 3 - UCC 024181 Page Two Labeling Instructions - VCM/PVC March 25, 1975 6. All bags shipped out of inventory in less than pallet load quantities shall have a 6005-3 label (l/V print). 7. All suspension and non-solvent bags in inventory shall be stamped on top or bottom, which ever is not used for resin and blend identification, using the Algene printers supplied. 8. All suspension and non-solvent bags on order shall be changed to include the Cancer Suspect statement in l/4" letters on each side of the bag. This will only involve TC and PA so if either have any questions, feel free to contact me. We must be sure that we proceed with the labeling in such a manner that we do not jump the gun and ship labeled containers prior to Agrll 1. Since only Suspension and Non-Solvent resins are involved, it should not be necessary to work on the holiday to complete the labeling. I am sorry we had to wait this long but you can now see why it was necessary. Even at this late date the Supreme Court action on the Suspension and Non-Solvent resins hasn't been resolved. EB/mg Att.
