R. Van Mynen, chairman, convened the meeting at 9:30 a.m. and made the following announcements: o The joint HSC/EMC meeting will be held from 3:00 p.m. to 5:30 p.m. on February 20, 1990; o The Steering Task Group will meet from 1:00 p.m. to 3:00 p.m. on February 20; o In its session on January 16, 1990, the Steering Task Group approved $500.00 to fund Dr. Wildavsky's presentation on risk and alternatives; and o The HSC meeting on February 21, 1990, will begin at 9:00 a.m. 2. Minutes The minutes of the December 20, 1989, meeting were approved as written. 3. Budget J. Willett and G. Strickland reviewed the budget and briefed the committee on the proposed FY 90/91 budget. 4. International Labor Organization (ILO) Convention and Recommendations on Safety in the Use of Chemicals at Work The committee heard presentations on recent and pending actions with regard to the ILO convention and recommendations. o On January 4, 1990, R. Van Mynen briefed CMA's officers on the issue and he and J. Plaut briefed the Executive Committee on January 16, 1990. o An Ad Hoc Worker Participation Work Group meeting will be held on March 15. For further information, contact H. Eschenbach or K. Creedon. o On January 10, 1990, K. Rosica briefed members of the Council of Chemical Association Executives (CCAE) on CMA's planned activities on the ILO actions. Key staff of the National Association of Manufacturers (NAM) will also be briefed, o An updated version of the Convention and Recommendations were received by CMA on January 16. Subsequently, CMA's comments were updated and approved by the International Affairs Committee. Following a detailed review of key issues and draft positions, the HSC provided recommendations to J. Charm and asked that he work through the Focus Area 3 ad hoc group on future modifications. K. Creedon and I. Rosenthal were identified as primary contacts for future actions. Additionally, the current position paper should be coordinated with L. Schaller, I. Rosenthal, H. Eschenbach and M. Finn prior to any release. 5. ATSDR Toxicological Profiles H. Lockhart asked that the committee approve the list of issues to be included in the 3rd set of draft toxicological profiles. The committee approved the listed issues without changes. Friedman asked that the committee approve the draft framework and model agreement for a voluntary research program under SARA Section 110. The committee approved the draft after discussions on the latitude that ATSDR is exercising in selecting chemicals for study and filling data gaps. The Hazard Assessment Task Group will consider the issue further at its next meeting. 7. Proposed Revisions to FIFRA and FFDCA A position statement submitted earlier to the committee for approval, was withdrawn. L. King briefed the committee on reasons for the withdrawal -- a growing political association of the term "negligible risk" with bright line risk numbers and the lack of definition of the suggested alternative term "unreasonable risk". I. Rosenthal asked that appropriate records be screened for information that, in combination, might suggest a clearer definition of "unreasonable risk". The Hazard Assessment Task group will confer with Government Relations to seek an acceptable solution. 8. Officers Meeting, January 4, 1990 R. Van Mynen and G. Strickland briefed the committee on presentations to CMA officers on; o Activities of the Ad Hoc Study Group on Imposed Risk; o The ILO Convention and Recommendations; o CMA's MSDS guideline development project; and o Sunsetting of the community exposure value pilot project. Additionally, R. Van Mynen mentioned that J. LeBeau will soon call members of the committee for nominees to attend and facilitate a high level meeting of persons influential and knowledgeable on risk assessment and risk management, for example, Ruckleshaus, L. Thomas, J. Moore, etc. K. Rosica answered questions about the proposed ORC/OSHA pilot project for databasing MSDS. 9 trga CMA 060988 A. The committee approved the following documents without change: o A letter to J. Melone, EPA, regarding changes in TSCA Section 5(e) consent order language; and o A follow-up letter to EPA on the December meeting regarding polymer neutralization salts. B. The committee also waived its rules to consider a presentation by J. Charm and a proposed letter to EPA regarding recent interpre tations and guidance on TSCA Section 8(e). A draft letter to D. Williams (EPA) was reviewed and considered but rejected by the committee. The committee instead asked that the Notification and Reporting Task Group quickly and carefully consolidate several recent examples of changing EPA guidance under various sections of TSCA and draft a letter to L. Fisher (EPA) including the examples HSC Meeting Minutes January 17, 1990 Page 4 which will be used at high level meetings with EPA to resolve adverse impacts of changing guidance, particularly when retroactively applied, C. A copy of a letter to C. Elkins (EPA) requesting a meeting to discuss, primarily, the agency's TSCA Section 6 review process and the OTS "pollution prevention" policy, was distributed to members as an information item. D. K. Rosica alerted members to a CMA meeting, scheduled for January 25, 1990, on TSCA Section 4 issues. 10. Information Management The committee approved expenditures of $20,000 to support a joint study with the National Library of Medicine on the utility of data documentation completeness indicators. The National Institute of Health is also contributing $125,000 to the project. 11. Ergonomics Questionnaire The committee approved an ergonomics questionnaire to be distributed to CMA member companies with the understanding that the appropriate prior clearance for surveys of CMA's member companies will be obtained by the staff. Some recommendations for modifications to the survey and its format were also made. 12. Sponsor Reports o J. LeBeau relayed, by telephone, his report on progress at the OECD existing chemicals meeting -- a screening information data set (SIDS) has been approved; Germany will test 8 chemicals; the Japanese government will test 10 chemicals; a combined protocol and one on reproductive effects are being resolved; requirements that SIDS data adhere to good laboratory practices (GLPs) will be loosely applied, particularly for analytical portions of the GLPs. A more fulsome report on these and other actions suggesting that the OECD activities are gaining momentum and broader acceptance will be discussed at future HSC meetings. o D. Sigman reported that CMA's views on the ABA Mass Tort report has been emboldened by CMA's general councils' group and will be distributed next week. o The committee's sponsors and focus area leaders -- M. Finn, M. Friedman, H. Eschenbach, H. Lockhart, E. Capaldi, L. Schaller and I. Rosenthal -- briefed the committee on activities, progress and important future meetings within their assigned areas. R. Van Mynen and J. Willett updated the committee on Responsible Care activities and progress on code drafting groups. I. Rosenthal and G. Strickland also discussed activities of the Board ad hoc subgroups on regulatory advocacy. I. Rosenthal asked that members send him or G. Strickland their best description of the desirable goal or vision statement for regulatory advocacy and to identify the key results or measures they would expect to see as evidence that CMA were progressing toward that goal or vision. Information Items The following information items, not included in the meeting book, were distributed at the meeting: o A report on the 101st Congress -- Activity on Health and Safety Issues; o Statement of the National Association of Manufacturers to the Subcommittee on Labor Management Relations Committee on Education and Labor re: H.R. 3368, Employee Health and Safety Protection Act, November 16, 1989; o Workplan of the Safety Programs Task Group; o A proposal for Industry Dialogue with EPA on Substantial Risk Reporting under TSCA Section 8(e); o Draft letter to Mr. Charles Elkins (EPA) concerning TSCA Section 6 Review Process and New Concepts for EPA and Industry Action; o Draft letter to Mr. David Williams (EPA) concerning TSCA Section 8(e); o An updated Tab 3 (January 17, 1990, HSC Book) -- ILO Convention and Recommendations on Safety in the Use of Chemicals at Work and a summary of its key issues; and a o Listing of hotels near CMA that provide corporate discounts for CMA member companies. )4.
