Section I - INTRODUCTION
Humble Feed & Pet Supply Inspection Date 12/18/2024
PURPOSE OF THE INSPECTION
I, EPA Region 6 inspector Lee McMillan accompanied by inspector Justin Mullenix arrived at the Humble Feed & Pet Supply at 2:45 PM on December 18, 2024 for an unannounced inspection. We asked for the person in charge. Derek Gutierrez volunteered to contact the owner, Luis Zepeda, via phone who was not on site at the time of the inspection. I explained to Mr. Zepeda the purpose for our visit, and he designated Mr. Gutierrez as his representative. I continued the Opening Conference with Mr. Gutierrez. I presented my credentials to Mr. Gutierrez and informed him that this was an EPA inspection to determine compliance with the Federal Insecticide Fungicide Rodenticide Act (FIFRA). The scope of the would be to review documents and any pesticide products for evaluation of the compliance with FIFRA (40 CFR Subpart 169.3 - Inspections).
FACILITY DESCRIPTION
Humble Feed & Pet Supply is a retail business registered in Texas. Humble Feed & Pet Supply primarily engaged in the importation of groceries and cleaning products. The company has approximately 3 employees.
Section II - OBSERVATIONS
On December 18, 2024, EPA Region 6 inspector Lee McMillan accompanied by inspector Justin Mullenix inspected the inventory in the Humble Feed store related to pesticides. During the investigation I viewed the showroom and the storage room in the back of the building. During the inspection I noted a product called Synbiont Agricultural Wash. The label made several pesticidal claims. The front label stated, "Helps meet the biosecurity protocols for preventing: EHV-1, E. coli, Salmonella, H1N1 bacteria, funguses, and viruses. The back label stated, "Ag Wash has been laboratory tested and shown to be an effective tool for helping control EHV-1, H1N1, E. coli, and Salmonella." and use instruction for animal stalls, living areas, and equipment. The product was produced by EQ AG Solutions, LLC located in Ruskin, Florida. The product did not list an EPA Registration Number or EPA Registered Establishment number. Photos were taken during this inspection.
Section III - AREAS OF CONCERN
I conducted closing conference with Mr. Gutierrez at Humble Feed & Pet Supply at 3:20 PM on December 18, 2024. I did observe a pesticide product called Synbiont Agricultural Wash that appeared to be out of compliance with FIFRA. I notified Mr. Gutierrez of the concerns with the product. No actions were taken at the time of the inspection. I concluded the inspection and exited the facility at 3:25 PM.
