Cosmetic Packaging Materials Committee-' Ladies and Gentlemen: In our report for the Committee's December meeting, we discussed SPFs successes in the battle against container mandatory deposit legislation as well as its victories in having anti-plastics laws declared unconstitutional in Minnesota (Clover Leaf Creamery Co. v. Minnesota) and Hawaii (Juice Tree Ha waii, Inc., v. George Yueri^ Continued vigilance and aggressive action have, so far, succeeded in maintaining open and free-flowing channels for plastics in the beverage container market. However, the United States Supreme Court opted against leaving the Clover Leaf Creamery case in a state of repose by granting the state's Petition for a Writ of Certiorari to the Supreme Court of the State of Minnesota. Since it would appear--but it-is no certaipty-nthat the most likely reason for granting the state's request would be to reverse Minnesota's trial and Supreme Court decisions declaring the anti-plastics law 'unconstitutional, we re gard the Supreme Court's decision to review the case as unfavorable, at least for now. We also discussed at length, in our previous report, the potential favor able regulatory fallout from Monsanto Co. v. Kennedy (Monsanto II),**/ the acry lonitrile beverage container case (AN case). Before going into more detail on the status of these and other state activities and regulatory affairs of signifi cance to this Committee, let us first brief you on what we have learned or are anticipating in the way of personnel shifts within the Food and Drug Adminis tration (FDA). It is my thought that the best opportunity for him to discuss these subjects might be with attendees at the Cleveland symposium.
