MONSANTO I write to suggest that we alter our plans slightly. I no longer believe that a conspiracy cause of action Is viable and we should not amend to bring it In. Aldabe v. Adams, 402 P.2d 34 (Nevada 1965) holds uneguivoo&liy at pp. 37-3B that the conspiracy cause of action runs from the discovery of Injury rather than from discovery of the conspiracy, and has a four-year statute of limitations. I'm also ooncerned that the case Involved a fraud claim. While the statute of limitations Issues were not applied to the fraud claim* the case certainly would provide the defendants with persuasive authority should they seek certiorari. I see no great advantage at this point in oallins the defendant's attention to this case by moving to amend to bring in a conspiracy count particularly when we are still within the period for a petition for certiorari. Unless 1 hear differently from any of you, I won't be working on the amendment motion, and suggest we strike all mention of it from the memo that Randall has been drafting. I'll focus my efforts for the next couple of days on the motion for partial summary judgment on the issue of fraudulent concealment.
