Section I - INTRODUCTION
PURPOSE OF THE INSPECTION
EPA Region 6 inspector Lucas Bomar arrived at Western Oklahoma Livestock Auction the "Site" or "Facility" located at 23031 West Frontage Road Clinton, OK 73639 at 10:30 a.m. on June 13, 2023, for an unannounced inspection. Inspector met with Mr. Brandon Hickey (Owner) at the Opening Conference. Inspector presented their credentials to Mr. Hickey and informed him that this was an EPA inspection to determine the facility's compliance status with the Concentrated Animal Feeding Operation (CAFO) regulations as authorized by Clean Water Act (CWA) Section 308. The scope of the inspection included a compliance evaluation of the facility's site operations and record keeping determining the designation of the facility as a CAFO. For biosecurity purposes, the inspector toured the site in overboots. Inspector was accompanied by Mr. Hickey.
FACILITY DESCRIPTION
Western Oklahoma Livestock Auction reported that they have sold a total of 81,474 combined cattle in 2022. They sell beef bovine and very few dairy cattle. Auctions are held Monday every week forty-seven weeks out of the year unless it is a holiday. Animals are housed for around 24 hours for each sale. Animals are housed in open pens. Pens are cleaned via scraping using a skid steer as needed. Lot scrapings are piled and then given away to 3rd party farmers. Mortalities are hauled off and buried as needed within 24 hours. The livestock market uses hay and pellet feed. Pellet feed is stored in a covered barn.
The site has one lagoon. The facility is sloped to direct all runoff to the lagoon. There are also drainage channels and pipes that help direct runoff to the lagoon. Sometimes solids are removed from the lagoon and added to the manure pile as needed. There is a large berm on the east side that prevents runoff from entering the nearby waterway. Mr. Hickey was not able to produce a liner certification or as-builts for the lagoon at the time of the inspection. Mr. Hickey was in the process of contacting the previous owner for the information at the end of the inspection. There was also no pole marker and vegetation is overgrown on the embankment.
Section II - OBSERVATIONS
Western Oklahoma Livestock Auction has the animal numbers required to meet the large CAFO regulatory definition using the 2022 sale numbers. Western Oklahoma Livestock Auction is well managed and organized with the only concern being the lagoon records and lack of a pole marker and embankment maintenance. No other potential issues were found during the inspection.
Section III - AREAS OF CONCERN
Inspector was not able to verify records for lagoon liner certification or as-builts to determine capacity. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part III.D.1.: "Liner Requirement: The permittee shall document that no direct hydrologic connection exists between the contained wastewater and surface waters of the United States. Where the permittee cannot document that no direct hydrologic connection through ground water exists, the ponds, lagoons and basins of the containment facilities must have a liner which will prevent the potential contamination of surface waters.")
There was no depth marker visible in the lagoon. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part II.A.2.ii: "Install a depth marker in all open surface liquid impoundments. The depth marker must clearly indicate the minimum capacity necessary to contain the runoff and direct precipitation of the 25-year, 24-hour rainfall event. The marker shall be visible from the top of the levee.")

The embankment of the lagoon was overgrown with vegetation. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part II.A.2.a.viii: "...(a) soils used in the embankment shall be free of foreign material such as trash, brush, and fallen trees;...") There were no other areas of concern found at the time of the inspection. EPA Region 6 inspectors conducted a closing conference for the Western Oklahoma Livestock Auction inspection at approximately 12:05 p.m. on June 13, 2023. During the closing conference, the inspectors reviewed findings with Mr. Hickey and provided him with compliance assistance brochures.
