Notes from Opening Conference EPA provided some background on its interest in the Site and explained the purpose of the inspection Access Issues if Any Describe N/A Inspection Observations and Sample Collection Site Owner/Site Operator/Responsible Party (Name, title and contact information) Site owner: Town of Marlborough; Site operator: Town of Marlborough Highway Department, 845-795-2272 Additional Persons Present at Inspection See attached sign-in sheet General Site Characteristics (layout of property, etc.) The Site is comprised of two parcels, identified by Ulster County records as Tax ID: 103.3-3-67, a 2.77-acre parcel located at 1650 Route 9W, Milton, NY and 103.3-3-66.100, a 3.94-acre parcel located at 7 Woodcrest Lane, Milton, NY. Both parcels are generally rectangular in shape, with 103.3-3-67 located directly north of 103.3-3-66.100. The Site is bordered by Route 9W on the west, Woodcrest Lane on the south, and privately owned parcels on the north and west. Parcel 103.3-3-67 includes the Highway Department Building, its parking lot, and various appurtenant structures. Two ponds with small wetland fringes are located along its northern boundary. Access to the parcel is off of Route 9W. Parcel 103.3-3-66.100 consists mostly of parking and storage areas. Piles of roadwork materials are located on the parcel. Wetlands are located near the eastern and southern boundaries of the parcel. The piped stream daylights on the parcel and flows east, off-site. Access to the parcel is is off of Woodcrest Lane or through Parcel 103.3-3-67. A United States Geologic Survey (USGS)-mapped stream enters 103.3-3-67 at its southwest corner and flows southeast through a pipe to 103.3-3-66.100 and then off-site, eventually draining to the Hudson River. The USGS classifies the stream as "perennial". The stream is also identified by the NYSDEC as "Class C" (best usage for fisheries and non-contact activities). Much of the southern portion of the Site is mapped by the NWI as a 1.46 acre PSS1C freshwater forested/shrub wetland. The stream corridors are mapped by the NWI as R3UBH Riverine Purpose and Need for Discharge of Dredged and/or Fill Material It appears that fill material was discharged to provide a storage space for roadwork materials. Site Overview (Past inspections, site description, permits, etc.) EPA's Wetland Protection Section has not previously inspected the property. The U.S. Army Corps of Engineers has not issued a permit for filling activities at the property. Scope of Inspection (Areas inspected or not inspected) EPA inspected areas along the boundary of the fill disturbance where filling activities had occurred as well as upstream and downstream of the stream piping. Effective August 2020 Page 3 of 5 Clean Water Act Section 404: Site Visit/Case Development For inspections authorized pursuant to Clean Water Act sections 308 and 404 (33 U.S.C. 1318 and 1344) Site Name Town of Marlborough - Highway Department Environmental Conditions (e.g., wind, rain, smoke, dust, temperature, snow) mostly clear/partly cloudy; low 70's Start Date April 22, 2025 End Date April 22, 2025 Field Work Conducted The purpose of the inspection was to document whether there had been a discharge of dredged and/or fill material into waters of the United States without prior Corps authorization. Data recorded during the inspection included handwritten notes of observations; documentation of wetland indicators; and photographs. EPA started the inspection by observing the stream on the southern portion of the Site. The stream, which had a defined bed and banks, was flowing and had been piped into a 48" corrugated plastic culvert. Fill material consisting of boulder, dirt, gravel, and wood chips had been discharged to sides of the stream and measured nearly 19 feet on its left descending bank and nearly 13 feet on its right descending bank. The stream channel measured between 6.5 and 8 feet wide. The stream channel was covered in a brown algae and had an unpleasant smell. Macroinvertebrates were not observed in the heavily disturbed stream. EPA walked along the limit of disturbance where fill material had been placed. Wetland vegetation including skunk cabbage and common reed was observed beyond the fill edge. Fill material including dirt, rock, asphalt, boulder, wood chips, asphalt tailings, gravel, ceramic, wood, black plastic bags, brick, and cinder block had been graded flat to create an elevated storage area. EPA observed piles of gravel, dirt, and wood chips on top of the fill area. Some fill appeared to be newly placed. EPA dug a soil sampling pit just east of the fill edge and south of the stream, and observed the presence of hydrophytic vegetation, hydric soils, and indicators of wetland hydrology (see attached data sheets). Based on this information, EPA determined that the soil pit was located in a wetland. EPA walked to the upstream end of the 48" culvert and observed where the stream entered the Site from under Route 9W before being piped under the southern portion of the Site. EPA also observed the western of two ponds located along the northern Site boundary.
