Dear Mr. Morris: VIS1A In regards to your request to Vista for Material Safety Data Sheets (MSDS) on the scrap metals you purchase from our company, following is our response. The Hazard Communication Standard requires that manufacturers supply MSDS for chemicals they determine to be hazardous, unless specif ically exempted in the standard. It is Vista's determination that the base metals we send you are "articles" as defined in the stan dard and therefore exempt. (An article is defined as a manufactured item: (i) which is formed to a specific shape or design during manufacture; (ii) which has end use function(s) dependent in whole or in part upon its shape or design during end use; and (iii) which does not release, or otherwise result in exposure to, a hazardous chemical under normal conditions of use.) In regards to potential contaminants on the base metals we have reviewed the materials we send you. The plant believes that there is little potential for you to receive contaminated metal which could result in potential employee exposure to hazardous chemicals. This determination is based on the chemicals used at the plant and general plant procedures regarding removal or handling of contam inated materials, such as asbestos.
