Comments are below. 1. Both products are shipped in connection with a DOT exemption or special approval. 49 CFR 172.203(a) requires such shipments to clearly show the exemption numbers. As you are aware, copies of the exemption and special approval must accompany each shipment. 2. If reasonable we should show the estimated quantity of VCM as well as the "bulk" designation. 3. Shipping papers must also be completed for the return of the trailer when empty. The "Empty: Last Contained" notation is added to the basic description. 4. The inside containers of organic peroxide must be properly labeled. The ice chest must be marked according to 49 CFR 173.312 (attached) which includes arrows and "This End Up" notations. 5. For now the Bills of Lading should be kept for a period of time which is not yet determined. We are working on a VISTA records retention policy which will determine the exact time. It will probably be three years. 6. For private carrier shipments such as this, no shipper certification signature is required. Please call if you have question on the above. Thomas G. (a) Each packaging having a rated capacity of 110 gallons or less and con taining a material classed as ORM-A, B, C, D, or E must be plainly, durably, and legibly marked on at least one side or end with the appropriate ORM des ignation immediately following or below the proper shipping name of the material. The appropriate ORM desig nation must be placed within a rectan gle that Is approximately V* Inch (6.3 mm.) larger on each side than the des ignation. The appropriate designation for each ORM must be: (1) ORM-A for an ORM-A. (2) ORM-B-KEEP DRY for an ORM-B that Is a solid and Is corrosive only to aluminum when wet. (3) ORM-B for an ORM-B other than that described in paragraph (a)(2) of this section. (4) ORM-C for an ORM-C. (5) ORM-D-AIR for an ORM-D that is prepared for air shipment and pack aged in accordance with the provisions of 5 173.6 of this subchapter. (6) ORM-D for an ORM-D other than that described In paragraph (a)(5) of this section. (7) ORM-E for an ORM-E. (b) When the ORM-D marking In cluding the proper shipping name can not be affixed on the package surface, it may be on an attached tag, (c) The marking ORM-A, B, C. D, or E is the certification by the person of fering the package for transportation that the material Is properly de scribed, classed, packaged, marked and labeled (when appropriate) and in proper condition for transportation ac cording to the applicable regulations of this subchapter. This form of certi fication does not preclude the require ment for a certificate on a shipping paper when required by Subpart C of this Part.
