The writer has given this matter his very oareful consideration and it appears to him that our Insured will be confronted with a serious difficulty in attempting to defend Proceedings for the recovery of Statutory compensation; not so muoh on the ground that the deceased was never employed by them in a process under the Aabestosls Soheme, but their inability to prove that the disease was not an injury by accident contracted out of and in the course of his employment with them. Ur. Crute, the solicitor noting for the widow on the instructions of the Trade Union, is, we know from past ezperienoe, a very shrewd and knowledgeable solicitor in auoh oases as this. He has rightly seized upon the recent tendency to so enlarge the meaning of the words - injury by aooldent arising out of, eto., as to bring In quite a number of diseases which may or may not be scheduled -'.thin the definition, where it oan be proved that the disease ?ss in fact contracted at work. The solloitor quite properly cites the case mentioned in your inspector's report. He might have also referred to the decision of the House of Lords in Fife Coal company v Toung - Butter-worth Vol. 33, page 107, as illustrating the broadening of interpretation to whioh we have referred. We ourselves are familiar with oases of tuberouloals amongst Hospital nurses and know of one at least in whioh County Court Judge has decided in the nurse's favour. We have handled several and have not yet been convinced that the defence is strong enough to enable us to suoceed. On the whole, we have come to the oonolusion that our Insured would be well advised to try and effeot a compromising settlement. It is noted that Mr. Crute is not assuming he has a cast-iron oase and indicates his preparedness to advise the acceptance of 75$ of the amount Involved if total dependency is proved. Crute oa Monday last, he referred to this oase, end mentioned the fact already known to ue, that he had new reoeived A Certificate of death from the Hedloal Board, and he was considering what aotlon to take. I told the Solicitor that presumably he had now eatlsfled himself that the deceased had newer been employed In a process named In the eoheme, and I assumed therefore that he would be dropping his claim against the 7/aehington Chemloal Co. Ur. Crute stated that this was far from being the oaee. He was of the opinion that he oould claim on two grounds. Tlrstly, he thought he had a reasonable chance of proving to the satisfaction of the County Court Judge, bearing In mind that death was undoubtedly due to Asbestosls, that the deceased had been employed In a process named In the scheme. If he vraa unsuccessful, the seoond ground for his claim would be that the contracting of the disease was an aooldent within the meaning of section 1 of the Act. Ur. Crute then enquired If I was familiar with the facts of the oase Uann Darlington Forge Ltd. Aotually, I knew of the decision reached but had never read a report of the case. Briefly the facts are that a workman suffering from Dermatitis made several unsuccessful attempts to obtain a Certifying Surgeon's Certificate. Eventually ne was successful In obtaining this Certificate, but an appeal by the Bnployers to the Uedioal Referee was successful. In November of 1944 the workman claimed compensation under Seotion 1 of the Aot, but the County Court Judge deolded against the Applioant. The oase went to the Court of Appeal who referred the matter back to the county Court Judge. The ease again came before His Honour Judge Gamon at the Darlington County Court in July last, and his Honour made an award In favour of the workman. I have read the Judgement in this case, but had not had an opportunity of perusing the report of the Appeal Court proceedings. I Indicated to Ur. Crute that Soorer's case was somewhat different. I oould not see how the Employers oould be liable to pay oompeneatlon. I took the opportunity of mentioning to the solicitor that I bad reason to believe that the Washington Chemloal Co., had reoently made an ex-gratla payment to the widow of a man named HqmlriXoa who had died from Asbestosls, but he had not been employed by the Chemloal Co. during the nine years prior to his death. This was mentioned with a view to seeing the Solicitor's re-aotion, and he at onoe stated that If the '.vaahington Chemloal Co. were proposing to make a sympathetic payment in Soorer's oase he would not advise Its aooeptanoe unless the payment l- "{ >"r< c' wm a substantial ona. As far as Ur. Crute knows the widow is tbs only dependant, and be believes that there la a grown up fa.mlly wbo are married, ao In all probability tbs widow was totally dependent on the deceased's- earnings. After some further discussion Ur. Crute did admit that all was not plain sailing, but assuming that If there la liability and the widow Is entitled to the mail Twin of 400, he would not adrlse aooeptanoe of anything less than 2300. Incidentally, the Solloltor mentioned that as we era wall aware, local authorities hare recently had to admit claims for compensation In respeot of eases where nurses have contracted Tuberculosis, and eery similar considerations applied In Soorer's oase. we know of oourse that Ur. Crute has a eery wide experience of compensation oases, and he frequently sots for oertaln of the Allied Offices. Bis opinions always . merit consideration, and It oertalnly seems to me that there V Is quite a lot in what he has to say. It will In due coarse be necessary to hare a word with the employers, explaining to them Ur.
