RHODE - CORPUS CHRISTI ASBESTOS RELATED MEDICAL FINDINGS WORKMEN'S COMPENSATION CLAIMS Victoria's current identified cases which have been logged on the OSI-IA form require an E-l form to be filed with the Industrial Accident Board within a specified time period. You were advised to hold this filing until further information was available. We are now in a position to advise how the E-l form should be completed for these identified cases as well* as for any future one. For the cases identified at this time, please com plete the E-l form and forward the entire form to the writer. Legal Department (Alan Burton) will accumulate all of these from Texas locations and deliver to our insurance carrier who in turn will arrange to deliver to the Industrial Accident Board with an explanation as to why they were not filed within the time limits specified. All future cases can be handled in the normal routine procedure already established. Attached is a copy of an E-l form with each question marked 'with an 0, an * or unmarked. We will only answer those items: identified with an 0 or an * and for those identified with an k the following suggested responses should be used. Any exposure- to asbestos should have ended at the time we were in compliance with OSHA standards which were enacted July 7, 1972 Question 26 - (Du Pont Category 1) Benign Asymptomatic Abnormalities. "Pleuralchanges not resulting in disability". (Du Pont Category 2) Benign Synptomatic ness. "Parenchymal changes without/with some symptoms of pulmonary difficulties". Delete with or without, whichever is medically correct. Ill (Du Pont Category 3) Malignant Illness "Pleural or parenchymal malignancy" Question 27 - (1) If current employee: "No lost time. Continues on same job at same pay rate." (2) If pensioner: "No lost time prior to retirement in 19___". If time lost, leave Question 27 blank. Each site will have to develop a communication time line for these employees assuming none have been advised of this action. When-you for ward the completed E-l forms to me, please also include a brief outline of what you would like to say to these employees con cerning the reason for filing the E-l and your expectations as to the outcome of the determination by the Industrial Accident Board. Also advise me if our suggested responses will cause a problem for you if and when the employee sees the E-l form.
