I. du Pont de Nemours & Company I have your telegram of the 29th ultimo stating that you cannot be present for the trial of the above case on February 12th nor the week of the 17th and asking whether I could defer the case beyond February 24th. Unfortunately, I cannot do so because in postponing the case re cently we agreed not to ask for a further continuance. If you are not here on the 12th instant, counsel for plaintiff will insist, I am sure, that we take your testimony by deposition, which, in my opinion, would be a tragic mistake. During the first part of the trial week before last, Judge Holcombe indicated that he' remembered vividly what he had learned about lead intoxi cation from you and for that reason, plus the fact that plaintiff's only medical vfitness, Dr. Young, was so indecisive about whether or not the plaintiff was suffering from plumbism, I think that your testimony to the effect that he is not will be most helpful. As I stated in my telegram I hate like everything to urge you to give up the long-deferred and much-deserved vacation but I think it highly important from the standpoint of the du Pont Company that you be here if possible. There are already three other cases pending and we are anticipating several additional ones before long. If I should find that the case is to be postponed I will, of course, telephone you immediately. Will you please wire or phone me of your final decision?
