PURPOSE OF THE INSPECTION
EPA Region 6 inspector Matthew Allen arrived at the CapturePoint, LLC / North Burbank Unit (NBU) 24 Battery (EPA ID No. OKU002197) at 11:00 AM on 1/25/2024 for an announced inspection. This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1389031) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. CapturePoint, LLC representative, Talia Clark participated during the inspection. There was no other federal, state, or local agency representatives present at the time of the inspection.
FACILITY DESCRIPTION
EPA conducted an inspection at the CapturePoint, LLC North Burbank Unit 24 Battery, where extreme freezing temperatures (below 0) caused a steel flowline to fail, spilling a company estimated 5 barrels of crude oil and 750 barrels of saltwater onto the soil and dormant vegetation. The spilled fluids migrated west, overland, approximately 300 feet before spilling into an unnamed tributary of Haines Creek. The spill travelled generally north along the impacted tributary until spilling into another unnamed tributary. The two unnamed tributaries continued north to Haines Creek.
Section II - OBSERVATIONS
I observed the release point of the spill (36.844502, -96.733018). Oil and produced water-stained soil and vegetation were observed in the area immediately surrounding the release point. The ruptured steel flowlines were present and not yet repaired at the time of the inspection. The damaged flowlines were isolated and taken out of service at the time of the inspection. I observed the point of entry (POE) (36.844452, -96.734203) into an unnamed tributary of Haines Creek approximately 300 feet west from the release point. At this same location I observed an elevated total dissolved solids (TDS) field reading of 6375 mg/L. This reading was the highest observed throughout the inspection. I also observed crude oil floating on the water in the main channel of the impacted tributary. See photos No. 2 and 3 in the photo log.
Continuing downstream, I observed a TDS field reading of 1522 mg/L immediately upstream from a temporary containment dam which had been created by the operator to prevent further downstream migration of elevated TDS waters. See photos No. 4 and 5.
I observed the confluence of the impacted unnamed tributary with another unnamed tributary of Haines Creek. At this same location I observed an elevated TDS field reading of 1239 mg/L in the main channel of the impacted tributary, see photo No. 6. I also documented the bed and bank features of the

impacted tributary which can be seen in photo No. 7. At this same location, immediately downstream from the confluence of the two unnamed tributaries, I observed a TDS field reading of 379.8 mg/L. At this point, the combined tributaries had increased the in-stream flow and dilution was impacting the ability to observe elevated TDS spill impacts. At Haines Creek, I observed identical TDS field readings of 346.4 mg/L on the upstream and downstream sides of where the impacted tributary entered the main channel of Haines Creek. The upstream TDS field reading of 346.4 mg/L taken in the main channel of Haines Creek should be used to help establish background TDS levels in the area. All TDS field readings were taken with a properly calibrated, EPA issued, YSI Pro 30 conductivity meter. Section III - AREAS OF CONCERN The primary areas of concern at the time of the inspection included the impacted soil and vegetation around the release point, the elevated TDS waters observed along the impacted unnamed tributary of Haines Creek and the crude oil floating on the water in the impacted tributary. Section IV - FOLLOW UP Inspector will follow up via phone calls and site visits as needed until the impacted area is cleaned to "pre-spill" condition.
