RULES AND REGULATIONS COMMONWEALTH OF PENNSYLVANIA DEPARTMENT OF HEALTH CHAPTER 4 Article 432 R e g u la tio n s Establishing Threshold Limits in Places of E m p lo y m e n t1* (Adopted October 27, 1961) 1; Section 1. Purpose The purpose of these regulations and standards is to p resc rib e minimum re q u ire m e n ts and sta n d ard s for the m aintenance of o ccupational health in places of employment in P en n sy lv an ia. Section 2. A pplication T hese regulations and standards shall apply to every place of employment. Section 3. D efin itio n s A. "A tm ospheric contam inant'* shall mean a harmful substance or m aterial in air usually occurring in the form of a d u st, fum e, g a s , vapor, or m ist, B. "D epartm ent" sh a ll mean the D epartm ent of H ealth, Commonwealth of Pennsylvania. C. "D u st" shall mean finely divided solid particles dispersed in air and having been formed by mech anical means such as grinding, crushing, blasting, and drilling. D. "F u m e" shall mean so lid p articles disp ersed in air resulting from som e chem ical or ph y sical p ro ce ss that involved a change of s ta te , su ch a.s combustion, sublim ation, or evaporation and'con densation. E. " G a s" shall mean a form less fluid occupying the space of enclosure. F . "G eneral or dilution ventilatio n " sh all mean ventilation provided to d ilute the concentration of du sts, fumes, g a s e s , vapors, or m ists in the atmosphere of all or part of the place of employ ment. G. "L o cal exhaust v e n tila tio n " sh a ll mean that type of ventilation in w hich su ctio n is applied at the point of generation of d u sts, fum es, g ases, vapors, and m ists. * Adopted pursuant to the provisions of the Adminis t r a t i v e Code of 1929: A c t o f A p r il 9, 1929, P .L . 177, os amended. H. " M is t" s h a ll mean liq u id d ro p lets s_ sp e n d e d in air. I. ''P la c e of em ploym ent" sh a ll m ean a lo c a tio n or site where an individual p o sse sse s employment in a trade, occupation, or profession for the sake of monetary gain. J . (am ended A ugust 18, 1964) ''T h resh o ld Lim it V alu e" sh a ll mean the maximum av erag e atm os pheric concentration of contam inant to which w orkers may be exposed for an eight hour work ing day. (T h ese values are se t forth in T able 1 hereof, which cable is a part of th e se regula tio n s .) ,K. ''V ap o r" sh a ll mean an y liq u id , e x c e p t w ater, w hich when held in su sp en sio n in air w ill revert to its o riginal liquid s ta te after re le a s e from h eatfchem ical action, or pressure conditions. L. (added A ugust 18, 1964) "Short-T rf L im it" sh a ll mean the maximum atm ospheric co n cen tra tion of a contam inant to which a workman may be exposed for a specified short-rim e period. The concentration rep resen ts an upper lim it of expo sure for the specified time and assum es that there are sufficient recovery periods between episodes for recuperation. The daily average exposure to the contam inant, including th ese episo d es, sh all be such that the threshold lim it value se t forth in T able 1 sh all not be exceeded. (T h ese values are set forth in T able 2 hereof, which table is a part of these regulations.) M. (ad d e d Ja n u a ry 25, 1968) "C o n fin ed s p a c e " s h a ll mean any tank, vessel or area so enclosed that adequate dilution vencilacion w ill not be obtained by natural air movement. REGULATIONS FOR THRESHOLD LIMITS S ectio n 4. E m p lo y e r 's D uties A. Every employer shall in stall and provide such control measures and protective equipment as is required for the protection of health. B. Every employer sh all inform and periodically instruct his employees regarding known hazards ?nd proper methods for utilizing industrial hy giene control m easures which are provided. C. When it is n e c e s sa ry for an em ployer to provide protective equipment, such employer shall pro vide an approved means for cleaning and steriliz ing such protective equipment, and the employer shall cause such equipm ent to be m aintained in a clean and sanitary condition. R espiratory equip ment shall not be p assed from one man to another until such equipment is clean and sterilized. When filter or cartridge type re sp ira to rs are used, such employee shall have such respirator for his own exclusive u se. R espiratory equipment and replacement units sh all be scored, when not in use, in approved containers. D. (amended August 20, 1963) When em ployees are exposed to compounds capable of causing occu pational d ise a se by inhalation an d /o r skin or mucous membrane absorption, the departm ent may require their employer to provide p h ysical exam inations and other te sts for them at period: in tervals. Section 5. Threshold L im it V alues and Short-Term Lim its A. (amended August 18, 1964) No em ployee sh a ll be exposed to atmospheric co n centrations of con tam inants which concen tratio n s may give rise co occupational disease. T ables ] and 2 shall be used for the determination of perm issible levels. B. Exposures to atmospheric contam inants or ad verse environmental conditions not referred to in Section 5A shall be con tro lled when n ec essary to protect health. Section 6. Air R ecircu lation and D isch a rg e A. No air from any local ex h a u st v e n tila tio n system may be recirculated w ithout ex p ress approval by the Department. B. The disch arg e of air from any ex h au st system sh all be such that no air contam ination w ill enter any window, door, or other opening of an ) work area in quantities sufficient to create a health hazard to or in such area. Section 7. Confined Space (amended January 25, 1968) No individual shall be perm itted to en ter any con fined space u n less another workman supplied with emergency protective equipment is stationed outside the confined space to summon help and to a s s is t the workman and until one of the three following condi tions have been met: A. It has been a s c e rta in e d by a ir sam pling th at the atm osphere in the confined sp ace c o n tain s an adequate quantity of oxygen and that harmful atm ospheric contam inants have been d ilu ted to safe concentrations prior to and during occu pancy; or B. The workman is equipped with a supplied-air respirator or self-contained breathing apparatus, a safety harness, a safety line and protective clothing, where necessary; or C. It is a sc e rta in e d that no harmful co n tam in an ts are present and m echanically induced dilution v en tilatio n is used before entry and during occu-> pancy to insure an adequate quantity of oxygen in the confined space. Section 8. Housekeeping A- The in te rio rs , ex terio rs, amd environs of build in g s 'here hazard o u s m aterials are u sed , scored, or handled, shall be cleaned and m aintained in such a manner as to prevent harmful exposure to hazardous m aterials. B- Em ployees engaged in such cle a n in g o p eratio n s and all others who may be exposed sh a ll wear protective equipment as is required. The cleaning operations should be done by suction apparatus. C. Where wet p ro c e sse s are u sed , re a so n a b le d rain age should be maintained.
