The 'University'of Oklahoma 630 Parrington Oval Norman, Oklahoma 7;3069 College of Law June 21, 1973 Dr. Rober t Kehoe Director Emeritus Kettering Laboratory Cincinnat i , Ohio Re: Noerrs vs. Sitkin Smeltering and Refining Company Dear Dr. Kehoe: Recently I saw an article in the May, 1973 Farm Journal, which repbrted on the Noerr Case. In that case it reported that you had testified for the Noerrs concerning the pollution of their farm. Recently, my sister discovered that her [registered herd of Hereford cattle was being poisoned. We learned through tests run at the laboratory at Oklahoma State University that it was lead poisoning that was killing the cattle and we have been attempting to trace the source. We believe it comes from an in dustrial plant which is located adjacent to the farm on which the cattle were located. Actually, what I am writing to you about is; (1) I would like to k now the name of the law firm which handled the Noerr Case and; (2) If there would be any possibility that you might be available to be employed as an expert witness. If you are not available, if you know of any other experts in this particular field located in the Southwest I would surely appreciate your assistance. DS:eas CoO- David Swank Professor of Law
