Crystal Square 4, Suite 509 Arlington, Virginia 22202 (703) 979-1150 June 4, 1982 Memorandum For: MEMBERS Subject: Forwarding of General Information of Interest The purpose of this memorandum is to inform members on a number of matters that would otherwise- have been covered at the second quarter Board of Directors meeting. It will be recalled that AIA/NA memorandum of April 29 advised that the June 9 directors meeting has been cancelled. This decision was deemed approriate for convenience and economic reasons since a significant number! of members attended the World Symposium on Asbestos (WSA) in '-'I Montreal last week, and it was not expected that any major de- ;[ velopments concerning resolution of outstanding regulatory issues would occur this quarter. The following paragraphs cover a wide range of subjects and are invited to your attention. Please don't hesitate to contact this office if additional information is desired. The WSA was held during the period May 24-27. The program in cluded some 60 speakers and about 650 persons were present. Bio graphical notes and abstracts of papers presented are enclosed. A list of papers obtained at the WSA is also attached; these papers are available to members on request. Additional information on the WSA is included in the May issue of News & Notes forwarded with this mailing. Federal regulatory matters are reviewed below: 1. OSHA a. See May issue News & Notes, page 4, for report on AIA/NA comments on proposed hazard communication rule. b. As to revision of asbestos standard, meetings have oc curred between OSHA and AIA/NA staffs since March directors meeting. OSHA staff is doing some work on a proposed revision. ! Thorough con sideration is being given to AIA/NA input, especially as pertains to use of work practices concept for regulation of construction indus try. It is not expected that any proposal will be published prior to the Association's annual meeting in September. A meeting is scheduled with Dr. Leonard Vance, OSHA's new Health Standards Direc tor on June 8. CAPCO JEN 0011753 Page 2 t 2. EPA a. The Agency is pursuing establishment of an interagency task force to coordinate federal activity on asbestos. Letters have been sent by EPA to OSHA and CPSC requesting representatives to participate. AIA/NA continues to work with EPA in an effort to achieve a more reasonable approach to regulation than that pub lished by the ANPRM in October 1979. It is hoped that EPA will eventually publish a revised regulatory approach under TSCA with emphasis on controls through labeling and use of work practices. b. The reporting rule prepared under Section 8(a) of TSCA is currently under review by the Office of Management and Budget. If approved, it would be submitted to the Administrator for con sideration and possible publication. If published, the asbestos industry would be required to submit a variety of information and data to EPA concerning asbestos usage, number of employees asbes tos exposure summaries, etc. Efforts are being made to urge issuance of this final rule after resolution of the Agency's revised strat egy for regulation under Section 6 of TSCA(discussed above). c. EPA continues to review its National Emissions Standard for Hazardous Air Pollutants(NESHAPS) for possible revision. Best estimate for any proposal is September 1983. Present indications are that the basic "no visible emissions" from point sources will not be proposed for change. AIA/NA continues to urge that wast$ disposal regulation should remain under NESHAPS and not be moved to RCRA. -. . d. See May issue News & Notes, page 6, for report on the Agency's final rule on asbestos in schools. 3. CPSC a. As previously reported(N&N Apr.), CPSC has invited suggestions for scientists to serve as members of a Chronic Hazard Advisory Panel(CHAP) on the use of asbestos in consumer products. Suggestions will be submitted to CPSC next week. Products allegedly of concern to CPSC at present are: asbestos paper and millboard, bulk asbestos fiber, dry mix furnace cement, wood and coal burning stove door gaskets, certain laboratory and artists'materials, and stove pads and iron rests. b. CPSC is expected to publish a booklet on "Asbestos in the Home" by late.July. This work was coordinated with EPA and AIA/NA provided detailed comments on the draft booklet. It is hoped that the final booklet will avoid sensational addressal of the subject and will provide factual information to the public. AIA/NA efforts to gain reasonable and appropriate regulation of as bestos and asbestos-containing products under California's Hazardous Substances Information and Training Act continue with latest com ments submitted May 20. Comments were also submitted on May 15, 1981, and February 1, 1982. So far excluded from requirements of Act are encapsulated products such as floor tiles and asphalt roof coatings. Latest AIA/NA submission requests extension of exemption to locked-in products such as asbestos-cement sheet and pipe. CAP CO JEN 0011754 . JZ The regular third quarter Board of Directors meeting and Annual Meeting will be held on September 15, 1982 at the Twin Bridges' Marriott Hotel, Washington, D.C. Based on the decision reached at the March 10 directors meeting, an industry-government conference will not be held in conjunction with the above AIA/NA meetings; however, it is planned to have three prominent speakers and to in vite nonmember industry representatives to be present. Invitations were extended to: Thorne G. Auchter, Assistant Secretary of Labor (OSHA); Dr. John A. Todhunter, Assistant Administrator for Pesti cides and Toxic Substances; and Nancy Steorts, Chairman, Consumer Product Safety Commission, to be dinner speaker on September 14 and breakfast and lunch speakers_ on_September 15, respectively. Chair man Steorts and Dr. Todhunter accepted their invitations to parti cipate. Dr. Leonard Vance, new Health Standards" Director,"will be the alternate OSHA speaker at dinner on September 14. Details re garding the September meetings will be provided in the near future. The American Industrial Health Council recently published the en closed booklet entitled "Cancer Pollution and the Workplace." The booklet will be of interest since it offers the best available estimates of the relative importance of cancer causation factors.
