I am in receipt of your check #629 in the amount of $41.30, as payment for the copies of materials being transmitted to you concerning our Monsanto Company inspections. Because the check must be made payable' to the U. S. Department of Labor/OSHA, as explained to you in the enclosed transmittal letter, I am re turning your check #629 to you for reissuance in the proper format.
I also wish to acknowledge your additional Freedom of Information request, as written on the DL Form 1-520, for all Monsanto "files before 1975." Our records indicate that one additional inspection was made-at the Monsanto Company in Fiscal Year 1972.
In July, 1975, our inspection case files for the fiscal year 1972 were "retired" to our Federal Records Center, GSA, Waltham, Massachusetts. The particular case file concerning our inspection at the Monsanto Company in 1972 was one of these retired files.
The National Archives and Records Service approved OSHA's request for authority to dispose of inspection case files in accordance with their Disposal Authority Schedule. Therefore, once a file is retired to the Records Center, its disposal is subject to that Schedule. The Monsanto Company 1972 case file was defined according to the Disposal Schedule as a "typical inspection case file relating to inspections of workplaces pursuant to the provisions of the Occupational Safety and Health Act of 1970." Because of this definition of this particular type of case file, the Disposal Authority as granted was to destroy all files meeting these specifications on January 1, 1977.
It is necessary to tell you that this Monsanto Company file which would complete your Freedom of Information request is no longer available for review, as it has been destroyed in accordance with the NARS schedule.
