Section I - INTRODUCTION PURPOSE OF THE INSPECTON
We, the Environmental Protection Agency (EPA) Region 6 inspectors Tony Robledo, Blake Sieminski, Kristen Latiolais, and the Louisiana Department of Environmental Quality (LDEQ) inspectors Glen Jenkins, Jamie Vicknair, Christopher M. Smith arrived at the Energy Transfer Company (ETC) Chalmette Cryogenic Gas Processing Plant at approximately 9:00 a.m. on April 9, 2024, for an announced inspection. We met with ETC facility representatives at the opening meeting. I presented my credentials and informed them that this was an EPA led inspection to determine compliance with the Clean Air Act (CAA) Section 112(r). The scope of the inspection was a partial compliance evaluation (PCE) and included evaluation of the compliance with 40 C.F.R. Part 68 - Chemical Accident Prevention Provisions, CAA Section 112(r)(7), and the General Duty Clause (GDC), CAA Section 112(r)(1).
FACILITY DESCRIPTION
The ETC Chalmette Cryogenic Gas Processing Plant takes in two gaseous feed streams from the PBF Energy Chalmette Refinery. These streams contain a mixture of hydrogen, methane, and various light hydrocarbons. The Plant produces three product streams, hydrogen, mixed light hydrocarbons, and residue gas. The residue gas is returned to the PBF Energy Chalmette Refinery where it is burned as fuel. The hydrogen is considered a product and sold. The mixed light hydrocarbons are pumped into the Geismar pipeline and transported to the Geismar Fractionator for separation and purification. The major processing steps are compression, drying, cryogenic light hydrocarbons recovery, separation of methane from the light hydrocarbons, product heating and product delivery. The Plant has the capacity to process approximately 50 million cubic feet a day (Mcf/d) of natural gas.
The substances present which are regulated under 40 C.F.R. Part 68 Chemical Accident RMP requirements include flammable mixture chemical components consisting of methane, butane, propane, ethane, ethylene, propylene, and isobutane. The flammable mixture chemical components handled and stored at the Plant exceed the respective regulatory threshold quantities. There is no RMP regulated toxic substances used at the Plant. The Plant started operations in 2001, and ETC took over ownership on May 2, 2011. There are approximately 15 fulltime employees at this non-Union represented Plant, and no full-time contractors working onsite. The Plant operates 24 hours a day, 7 days a week.
Section II - OBSERVATIONS
EPA Federal and LDEQ State inspectors conducted a walk-through of the facility, accompanied by facility representatives, to observe the facility process equipment, and overall operations. We used the Forward Looking Infrared (FLIRTM) Series GF320 camera, and observed no spills, leaks, or fugitive hydrocarbon emission trails. Other inspection findings and observations are noted in the RMP Program Level 3 Checklist, located in Appendix #1.
During the walk-through, we observed that the facility was missing proper markings on piping (Photo Nos. 1, 2, 3, 4, 5 and 6, located in Appendix #2) - e.g., direction of flow, color-coding to identify the hazardous material present, placement of pipe labels, and type and size of letters on pipe labels, as required by the American National Standards Institute (ANSI) and the American Society of Mechanical Engineers (ASME) Standard ANSI/ASME A13.1, Scheme for the Identification of Piping Systems. This standard is considered a recognized and generally accepted good engineering practice for above ground piping systems.

Section III - AREAS OF CONCERN
Closing Meeting - EPA convened a closing meeting on Thursday, April 11, 2024, to discuss the Areas of Concern (AOC) noted during the inspection, the inspection completion process, and to answer questions from Plant representatives.
AOC 1. 40 C.F.R. 68.65(d)(2) - Process Safety Information
The owner or operator shall complete a compilation of written process safety information before conducting any process hazard analysis required by the rule.(d) Information pertaining to the equipment in the process. (2) The owner or operator shall document that equipment complies with recognized and generally accepted good engineering practices. ETC failed to properly label process equipment piping, as required by ANSI/ASME Standard A13.1, Scheme for the Identification of Piping Systems.
AOC 2. 40 C.F.R. 68.67(e) - Process Hazardous Analysis (PHA)
(e) The owner or operator shall establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions.
ETC failed to promptly address team findings and recommendations from a PHA conducted in June 2022. ETC identified 28 recommendations of which 22 were closed and six remain open with a schedule for completion.
AOC 3. 40 C.F.R. 68.71(c) - Training
(c) The owner or operator shall ascertain that each employee involved in operating a process has received and understood the training required by this paragraph. The owner or operator shall prepare a record which contains the identity of the employee, the date of training, and the means used to verify that the employee understood the training.
ETC for one operator documented the completion of initial training but failed to maintain the operator examination document to verify that the initial training was completed.
On May 1, 2024, ETC provided the operator examination documentation and verified that the initial training was completed.
AOC 4. 40 C.F.R. 68.73(e) - Mechanical Integrity
(e) The owner or operator shall correct deficiencies in equipment that are outside acceptable limits (defined by the process safety information in 68.65) before further use or in a safe and timely manner when necessary means are taken to assure safe operation.
ETC for Pressure Vessel 16.08 failed to correct deficiencies identified in a February 18, 2014, external inspection

The deficiencies that were not corrected included a damaged jacket on the east end of the vessel and damaged fireproofing on supports. ETC for Pressure Vessel 16.630 failed to correct a deficiency identified in a February 18, 2014, external inspection which was also identified in a February 20, 2019, external inspection. The deficiency that was not corrected included properly sealing a grounding wire at the base of the pressure vessel skirt. Section IV - FOLLOW UP There were no additional records requested and no additional follow up for this inspection.
