New Jersey workers' compensation has awarded for psychiatric disability in asoestos cases, we nave appealed toree such awards ana ao not expect an opinion until 1985.
The New Jersey appellate Court dismissed both Du Pont and
the medical coctors from the civil suits in June 1983. An appeal to the N.J. Supreme Court, which heard rearquments in Seote^Per, 1984, `is still pending. The Delaware Superior Court dismissed Du Pont from civil suits in August 1983. An appeal to toe Delaware Supreme Court was resolved when the Court found that recovery for olaintiff-emoloyees is limited to workers' compensation.

/ Asbestos Epidemiology
The C&P Asbestos Program Update shows a continuing decline in new benign asymptomatic (8A) and benign symptomatic (BS) cases. New malignant (MAL) cases increased from 4 in 1983 to 6 in 1934. Four of the six malignancies were oreviously classified BA in 1930 or 1981; one was previously classified BS in 1982. Through 1984, C&P has 45% of the Company asbestos cases.
Definitive data to -Characterize progression of BA to BS or MAL does not exist at this time. The study of asbestos-related medical conditions, being conducted by Corporate Medical will provide more specific data and a basis to evaluate future changes. The study includes employees and pensioners with asbestos-related medical conditions for which Du Pont has accepted responsibility. Preliminary analyses for some plants are expected by year-end 1985.
Right-to-Know/Hazard Communication
On January 3, 1985, a federal judge ruled that OSHA Hazard Communication law preempts the New Jersey Right-to-Know law. At this time the New Jersey plants have suspended riaht-to-know activity pending appeals or new lawmaking action by New Jersey.
