Thank you for your letter to me dated November 19, 1993. I regret that a copy of Sherwin Williams' calculations was not included with my November 19, 1993 letter. I enclose a copy of a summary of benefits paid to you, which summary was prepared by Sherwin Williams Company. I am having difficulty integrating Sherwin Williams' calculations with the calculations set forth by Peter Mills in his October 3, 1991 letter. I am sending a copy of this letter and Attorney Mills' October 3, 1991 letter to Anthony J. Colangelo, Manager of the Workers' Compensation Department of Sherwin Williams Company. By copy of this letter I am requesting that he review Peter Mills' calculations in light of his calculations. I will communicate with you after I hear from Mr. Colangelo.

I have calculated interest as follows. By the time this decree is paid, the petition will have been on file for a total of 14 months which would, ordinarily, entitle the recipient to 7% interest (6% per annum); but because the amounts have fallen due on a week by week basis during the pendency of the proceedings, it is appropriate to cut the interest rate in half in order to approximate the calculation for interest on each payment as it fell due.
From 10/1/91 onward until
LTD benefits run out on August 20,
1992, I think his weekly compensation check should be $127.95
calculated as follows. The taxable LTD amount is $1,125.83 per
month. When you multiply this figure by 12 and divide it by 52, you
arrive at a figure of $259.81 as the weekly value of the taxable LTD
benefit. When you deduct this figure from $387.76, it yields a net
compensation payment of $127.95.
In support of these various calculations, you will find enclosed:
A letter from the LTD carrier enclosing their worksheet
explaining how
benefits have been calculated.
W-2 from the LTD carrier for 1990 summarizing the amounts paid.
Various LTD pay stubs for 1990 and the first part of 1991 documenting the amount paid as taxable and non-taxable benefits.
Also enclosed you will find copies of those medical bills that we
know about. We will check to see what others there may be. We will
also check concerning
claim for travel expenses. It is not
likely to be significant.
