Zt has become apparent that asbestos fibres may endanger the health of persons working with or exposed to asbestos and asbestos containing products. Insurance against liability from the use of or exposure to asbestos has become impossible to obtain. For the safety of employees and others, and for protection against future liabilities, it shall be the policy of Foster Wheeler Corporation and its subsidiaries not to install, remove or otherwise handle, directly or by subcontract, asbestos or any asbestos containing product on any project, and not to incorporate asbestos or any asbestos containing product in any product to be sold by the Corporation or any of its subsidiaries.
In the evont a customer specifies the use of asbestos or any asbestos containing product, efforts shall . be made to have the specification changed prior to submission of a bid. If those efforts are unsuccessful, or if a project necessarily involves exposure to or handling of asbestos or asbestos containing products, no bid shall be submitted without the specific approval of the Management Council, which, if given, may be conditioned upon obtaining a suitable indemnity against future liability.
Until June 1, 1984 the following exceptions will be made to the above Policy:
I. With respect to operations in the . S. and Canada, and in connection with repair, maintenance and revamp work only, operating entities in the Foster Wheeler group
' may bid on and enter into contracts for work which, incidental to the overall project, involves removal of previously installed asbestos containing materials under the following conditions:
a) On each job, reasonable efforts shall be made to obtain an indemnity from the customer to have asbestos liability eliminated from any indemnity given by Foster Wheeler.

b) Whenever possible Foster Wheeler should not subcontract asbestos removal work. This will give control over adherence to safety standards and should insure that necessary records are maintained and securely kept for future reference. Where subcontracting 'is necessary the subcontractor should be required to indemnify Foster Wheeler and the customer and to follow the procedures outlined
here.
c)
General safety procedures for all projects will be established by the Manager. Construction Safety Services, and reviewed by an independent third party for compliance with OSHA and other applicable regulations and for possible upgrading for more_ - ' adequate protection. Each individual project.will be reviewed by the Manager of Construction Safety Services to provide additional safety procedures for circumstances peculiar to that, project.
d) The Manager of Construction Safety -Services will establish a system of record keeping so that with respect to each project there will be a permanent record of (a) the safety measures taken, (b) conditions encountered on a daily basis, (c) names and social security numbers of persons expose-, (d) pictures of the site showing signs, roped-of. 'areas, etc., (e) disposition of asbestos materials and {f) anything else-that might be relevant i* * . claim arises at some later date. Efforts should be made to obtain job histories from employees showing previous exposure to asbestos.
The foregoing records shall be kept for at least fifty years in a way that will permit retrieval in -.the distant future and will guard against destruc-ion and loss.

f) The Manager of Construction Services shall report
periodically to the Management Council regarding compliance with safety procedures at eaeh site and steps taken to comply with the aforesaid record keeping requirements.
II. With respect to operations outside of the 0. S. and Canada, and in connection with repair, maintenance and revamo work only, operating entities in the Foster Wheeler group may bid on and enter into contracts for work which, "incidental to the overall project, involve removal of previously installed asbestos containing materials provided the operating entity responsible for the project adopts procedures approved by the Management Council similar to those outlined in a) through f) above.
This Policy will be reviewed by the Management Council in June of 1984.
