Jutz(iza) de Direto da Vara Criminal Dear Judge: [a m writing to protest the filing of charges by em it S.A. against Dr. Fernanda Giannasi seeking prosecution for defamation under the Penal Code, in this w e join with the Society for Occupational and Environmental Hearth, the American Public Hearth Association, the White Lung Association and manv unions in Brazil, the United Kingdom, and other European countries. ' r* Gtannasf has done nothing more than exercise what we in the United States refer to as the right of freedom of speech. She has rightly criticized Etemit for sending lawyers to trick former employees mto signing complex legal documents offering indefinite compensation in return for releases from liability. She has justifiably criticized toe asbestos industry for publishing propaganda in medical journals of the Third World, specifically an Argentine medical journal whose publication o f Asbestos Institute literature was publicly condemned by leading asbestos experts from around the world. - n is PP^n9 ihe company would try to use the criminal courts of Brazil to threaten and try to silence Dr. Oiannasi. The threat is felt throughout the Ministry of Labor where Dr. Giannasi has served for 15 years as a distinguished public servant. It is therefore incumbent upon the court to firmly reject this effort to intimidate Dr. Giannasi and other labor inspectors whose job it is to protect workers from health and safety hazards in B razil it is also appropriate feat the court make it clear to companies such as the French corporation of which Etemit is a subsidiary, that Brazil wilf not accept toe discredited technologies banned in other countries and punish those who speak out against this injustice.
