Vista's Appendix D regarding vinyl chloride regulations should be attached. 2. Item 7, Indemnity, should be revised to shift the burden of proof to the contractor. The following language Is proposed: Insert the following after the parenthetical, "only if proven by contractor to be", and delete the word "If". 3. Based on our concerns regarding contamination of aquifers by drilling activities, should we ask the contractor to obtain Environmental Impairment Insurance to assure the funds are available to meet the Indemnities? The practicality of this is realized, but it should be considered. Bill McClain will be discussing Item 2 with Jerry Peterson. Also, we would like to see any changes he is making in the contract.
