RECORDS AFFIDAVIT Before me, the undersigned authority, personally appeared William B. Papageorge, who, being by me duly sworn upon his oath, on this 17th day of January 2008, deposed as follows: 1. My name is William B. Papageorge. I am of sound mind and legal age, capable of making this affidavit, and have personal knowledge of the facts herein stated. 2. I have a B.S. in Chemical Engineering from Washington University, awarded in 1943, and an M.S. in Chemical Engineering from Washington University, awarded in 1947. 3. I was employed by Monsanto Company (Monsanto) for approximately 35 years between 1951 and 1986. During that employment, I worked at the J.F. Queeny Plant in St. Louis, Missouri (1951 - 1964), the W.G. Krummrich Plant in Sauget, Illinois (1964 - 1965), the Anniston Plant in Anniston, Alabama (1965 - 1969, Plant Manager) and company headquarters in St. Louis County, Missouri (1970 - 1986). Polychlorinated biphenyls ("PCBs") were manufactured at the Anniston plant from before the time of my employment until April 1972. PCBs were manufactured at the W.G. Krummrich Plant from before the time of my employment until 1977, when Monsanto ceased the manufacture and sale of PCBs for all purposes. Commencing in January 1970,1 was appointed Manager of Environmental Control for Monsanto to assist Monsanto in responding to the developing information about PCBs being reported in the environment. I retired from Monsanto effective December 31, 1986. At the time of my retirement, my title was Manager, Occupational Health. 2734263.01 1 WATER PCB-00037519 4. During my employment with Monsanto, I became very familiar with (a) Monsanto's own business records made and created by Monsanto in the ordinary course of its business in relation to PCBs; and (b) with records relating to PCBs obtained from third parties and kept by Monsanto in its files in the ordinary course of its business in relation to PCBs. 5. Attached hereto as Exhibit 1 is Notebook 1 of 5 containing letters Monsanto sent to its customers about PCB issues between approximately March 3, 1969 and October 26, 1970, with Exhibit stickers labeled WBP M-87 - M-109, bearing the bates numbers noted in the Index to Notebook 1, which describes generally each of the exhibits contained in Notebook 1. The Index to Notebook 1 is marked as Exhibit 1-A to this Affidavit, and is attached hereto and incorporated herein by this reference. 6.
