A/C Pipe Producers Association MINUTES Committee: Place: Date: Public Affairs Committee Alexandria, Virginia October 13, 1981^ The AACPP Public Affairs Committee met on Tuesday, October 13, 1981, at 9:10 a.m., at the Old Town Holiday Inn, Alexandria, Virginia, the Chairman being in the chair and the Secretary being present. Call to Order The Chairman declared a quorum present and called the meeting to order. II. Reading and Approval of Minutes A motion was made and passed " ... that reading of the June 9,1981 minutes be dispensed with and approved as distributed." HI. Review of Agenda The meeting agenda was reviewed and the order of business modified as follows. IV. Report of Officers A. Chairman's Report The Chairman complimented Staff on the progress made in implementing the Public Education Program. B. Staff Report None. V. Priority List A. Strategic Operational Plan 1. PAC-01-80, Regulatory Affairs Program (RAP) a. Mr. Dougherty (CT) reported on the status of regulatory negotiations with the EPA Office of Toxic Substances (OTS). Staff reported that the latest information from Kirkland & Ellis indicated that OTS officials had.approved preparation of a new -1- CAPCO JEN 0033463 c Advance Notice of Proposed Rulemaking (ANPRM) for asbestos and asbestos containing products. If approved by the EPA Administrator, the new ANPRM would be less onerous than the original, and would attempt to coordinate regulatory activities between EPA and OSHA. Staff reported that it was working with Kirkland k Ellis in the review of position papers on control technologies and worker exposures in A/C pipe manufacturing and during product installation. It also was reported that Staff had submitted comments on the GCA report, "Asbestos Substitute Performance Analysis - Section 4, Asbestos Cement Pipe." Staff reviewed the latest EPA Drinking Water Research Progress Report. The findings of the Puget Sound and Pensacola epidemiologic studies (no association between asbestos and drinking water and disease) were described. After discussion, a motion was made and passed " ... that the Regulatory Affairs Program be approved with minor modifications recommended by Staff." 2. PAC-02-80, Public Education Program (PEP) a. Status of 1981 Program. Staff gave a detailed status report of the current PEP program. c Lewis k Gilman made recommendations on revising the "A/C Pipe and Drinking Water" booklet and A/V program. The Committee expressed an interest in reviewing an outline of these recommendations prior to implementation. Mr. Stinson (J-M) expressed the opinion that the Opinion Research Corporation report, "A Study of Water Pressure Pipe Systems and Materials" (October, 1980) was an important document with respect to guiding PAC programs. Since a number of Committee members were unfamiliar v/ith the report, a motion was made and passed, " -- that an Ad Hoc Committee comprised of Stinson (J-M), Baker (CT) and Perrell (CAPCO) be formed to review, analyze and report on results of the Opinion Research Corporation study." b. Review of Recommendations for 1982 PEP Staff reviewed program modifications, particularly "A/C Advisory." The Committee rejected Lewis k Gilman's recommendations for renaming the purchased space version of "Advisory." The Committee suggested that, if possible, the format of "Advisory" (as published in trade journals) be designed to look like a mail gram or telegram. There was some skepticism about the need to produce 3-ring binders for the conventional "A/C Advisory." Staff was directed to prepare a self-addressed mailer to determine reader interest in receiving such binders. c 3. PAC-04-81, State Monitoring Program (SMP) Staff reviewed program status and reported that briefings for special counsel in California, Arizona and Texas are planned. 4 2- - \ ii CAPCO JEN 0033464 4. PAC-05-81, Targeted Seminars Program (TSP) A motion was made and passed, " ... that the program be approved as proposed and renamed the Targeted Promotion Program." * * * * Recess for Lunch * * * * Old Business A. AWWA Ad Hoc Committee on Asbestos in Drinking Water Staff reviewed the language of Draft #5. Mr. Olson (J-M) reported that contacts with AWWA staff suggested that a June, 1982 date might be likely for approval and publication of the Committee statement. B. Field Problems & Litigation 1. Connecticut - Petition for Declaratory Ruling Staff reported that special counsel would follow up with the Assistant Attorney General to determine if the Commissioner of Health Services would administratively acknowledge withdrawal of industry's petition. 2. Crivitz, Wisconsin Staff and Counsel reviewed their role in assisting defense counsel for the trial. The findings of the court (no significant levels of asbestos present) were read. 3. Weston, Wisconsin Mr. McCallie (J-M) reported that no complaint had yet been filed against J-M. He also advised that materials regarding the pending litigation had been forwarded to AACPP counsel for defining legal options for AACPP intervention; 4. Lakewood, California Staff discussed the report prepared by the City of Lakewood and advised that it would be distributed in the future. 5. Salem, Illinois and Crookston, Minnesota Mr. Perrell (CAPCO) gave a status report on the unfavorable outcome of these two field problems. He advised that CAPCO's attorneys were reviewing the Crookston case with an eye towards legal action. 6. Blairsville, Pennsylvania Mr. Olson (J-M) gave a detailed status report. C. Critique of Kanarek et al Epidemiology Study A motion was made and passed, " ... that the Executive Committee fund a critique of the Kanarek study." Staff was directed to obtain a detailed proposal from Dr. Kenny Crump. -3- *i CAPCO JEN 0033465 A% \ D. Revised Aggressive Water Policy The existing AACPP Aggressive Water Policy was reviewed and discussed. Mr. Olson (J-M) distributed suggested changes and Staff agreed to letter ballot the revised policy for comment and approval. VII. New Business A. Industry Response to Kanarek - Conforti Article on Corrosion of A/C Pipe Staff reported that it was awaiting the analysis of Dr. Leineweber (J-M) preparatory to developing a response. Consistent with the recommended action plan, Staff advised that it planned to issue an nA/C Advisory" articulating industry's position on the article. Counsel questioned the advisability of this action on the basis that the "Advisory" might draw more attention to the article than it would otherwise obtain. Staff was directed to circulate to the Committee industry's response in advance of publication. Reconsideration of the advisability of issuing an "A/C Advisory" would be made at that time. B. AACPP Response to Public Statements by EPA Officials Mr. Olson (J-M) expressed the view that AACPP should more aggressively rebutt false claims and misinformation disseminated by EPA officials, particularly scientists from the Health Effects Research Laboratory (HERL). After considerable discussion, Mr. Olson (J-M) and Mr. McCallie (J-M) agreed to draft a protocol for Committee review and approval. C. Culligan Advertising Mr. Olson (J-M) reported on radio advertising, sponsored by the Culligan Corporation, which claimed that its filtration equipment removed dangerous asbestos fibers released into drinking water from A/C pipe. J-M will coordinate with Staff to obtain a copy of the radio script and determine need for action, if any. Vin. Adjournment The meeting adjourned at 2:05 p.m. J. F.
