J. 0B401 July 39, 1979 Dear M r. Oliver: In confirm ation of our telephone conversation of July 19, 1979, you are authorized to investigate the lawsuit Thomas E. W estfall and Elizabeth W estfall versus W hittaker, Clark & Daniels, et al versus M etropolitan Talc Company, for Cyprus Mines Corporation. As I have indicated, M r. W estfall, as an em ployee of Uni royal, allegedly contacted m esotheliom a from breathing in talc while employed at a rubber plant in Rhode Island. Talc may have been provided by W hittaker, C lark & Daniels, a sales agent for M etropolitan. Cyprus is in the p ro cess of acquiring M etropolitan Talc Company and thus the investigation m ust be com pleted by August 17th. Q uestions which we have developed a re as folLows: 1) We need the d e ta ils of th is claim including other defendants. 2) We need the full em ploym ent h isto ry of M r. W estfall, including em ployers, plants, construction of plants, i.e . asbestos type m a teria l, m aterials worked with including the tra d e nam es of ta lc s , m edical history, including smoking, p rio r w orkers' compensation or liability claim s submitted, protective clothing worn during employment. 3) We need th e full h isto ry of product shipm ents and d ates from W hittaker, Clark & Daniels to Uniroyal such as Canada or New York tale. 4) We need d etails on M etropolitan talc o p erations, including d a te s, lim its and provisions of insurance coverage relating to this claim , production of crude and source of crude ta lcs.
