EPA REGION 5 lead inspector presented credentials to Facility and informed them that this was a EPA REGION 5 inspection to investigate elements of the Clean Water Act (CWA) and applicable regulations. This report is based on information supplied by Schmitz Ready Mix representatives, direct observations made by the EPA REGION 5 inspectors, records and reports maintained by the permittee and other information including: photographs taken by EPA REGION 5 inspectors, physical evidence collected by the EPA REGION 5 inspectors, measurements taken by EPA REGION 5 inspectors, verbal or written statements made by information supplied by Schmitz Ready Mix representatives during or subsequent to the on-site inspection, and materials, processes, data, photographs, or documents shown, demonstrated, or submitted to the EPA REGION 5 inspectors by Schmitz Ready Mix representatives during or subsequent to the on-site inspection. In addition, information gathered prior to or subsequent to the Inspection from a review of EPA, State, and/or public records may be included in this report. Yes Yes No Facility/Site Description EPA REGION 5 lead inspector confirmed the following Facility information: Schmitz Ready Mix applied for and was issued a General Permit to Discharge Under the Wisconsin Pollution Discharge Elimination System WPDES NO. WI-S067857-5 Tier 2 Industrial Facilities dated May 14, 2021. The Facility operates a ready-mix concrete batch plant with ingredient material storage onsite. Ancillary activities such as truck washout, concrete material recycling, and a covered repair shop are additionally housed onsite. Material comes in via trucks, is stored in sheds and put into silos to mix with cement. The Facility is serviced by municipal water and all septic is handled by the Milwaukee Metropolitan Sewerage District. Wastewater from the mixing process flows into a series of settling basins (3). From there material is hauled to a gravel pit offsite and the water gets reused in the process. Most stormwater is collected via a series of catch basins in the main yard and discharges to Menomonee River via two outfalls. Mr. Schulz was not aware of the outfalls to the Menomonee River and believed stormwater from the Facility discharged into the stormwater sewer of the City of Milwaukee. Best management practices (BMPs) employed include, frequent sweeping and sediment filters placed at each catch basin. There were no records of BMP maintenance or a Stormwater Pollution Prevention Plan (SWPPP) on site at the time of the inspection. Quarterly, semi-annual and annual inspections and reports are performed by Endpoint Solutions, a contractor. The approximate drainage area of outfall 001 is 4.12 acres and this outfall area consists of 100% impervious surfaces, including concrete and compacted gravel surfaces. This storm sewer line runs south, southeast down the center of the property towards an outfall to the Menomonee River. Stormwater that falls to the ground surface in the southeast corner of the Facility flows overland via sheet flow towards single catch basin routed to outfall 002, approximately 60' southeast along the river frontage from the southwest property interface with the Menomonee River. The approximate drainage area of this outfall is 0.34 acres and this outfall area consists of 100% impervious surfaces including concrete and compacted gravel surfaces. Aggregate and recycled material is stored in piles throughout the area. SECTION II - OBSERVATIONS Location: Outdoor area Observation #: AH2-OB-001 Date: 02/22/2024 Weather: Sunny and close to 60 degrees Fahrenheit EPA observed the following, during the walkthrough of the outdoor area: Starting from the north side of the Facility, there is a covered machine shop where maintenance takes place. The floor of the machine shop has a blind sump from which any liquid material that accumulates can be vacuumed and disposed offsite. Outside and at the southeast corner of the machine shop, EPA observed a couple of drums containing used oil and an IBC tote that did not have secondary containment. This area slopes towards one of the stormwater catch basins on site. To the east of the machine shop and at an elevated area, EPA observed a shed with an open front that was split into six stalls where various aggregate material (sand, gravel and cement) was stored. EPA observed aggregates exposed to precipitation in front of the shed. South and just a few feet from the shed, EPA observed two more piles of aggregates that were not covered. This area has a steep slope towards the center of the Facility, where a couple of stormwater catch basins are located. EPA observed two stormwater catch basins, one in the area between the machine shop and the office building, and the other one just east of the office building. Most of the runoff from the area outside the machine shop, the shed area and the east side of the Facility where the concrete mixing happens would drain into the first catch basin. The first catch basin then connects underground to the second one. EPA observed runoff going into the second catch basin at the time of the inspection. Both catch basins had sediment filters in them. EPA noted that there was a significant buildup of sediments in both filters. East of the office building, EPA observed two 3-tiered settling basins. One of the basins was heated and to be used during the winter months. According to Mr. Schulz, the cement-mixing trucks have a 200gallon tank filled with water that they use to wash the top of the trucks. Next to the settling basins, there was a washing system to wash the inside of the mixing drum that used recycled water from the settling basins. Any wash water from the truck-washing was draining into the settling basins. Just south of the Showroom building, EPA observed another stormwater catch basin that had a sediment filter in it with plenty of sediment buildup in and around it and next to a big aggregate pile. EPA observed big piles of aggregates and recycled material from the settling basins next to the Menomonee River. There is a concrete wall south of the piles, about 1 foot high, to contain the material from falling on the banks of the Menomonee River. However, EPA observed material falling above the wall and into the banks of the river. At the southwest part of the Facility, EPA observed more aggregate piles, a sand pile, a rebar pile and a stormwater catch basin that did not have a sediment filter in it. The area had an opening in the concrete wall by the river and a constructed channel/pathway on the north bank of the Menomonee River. EPA observed outfall 002 discharging into the Menomonee River at the time of the inspection. There was no precipitation or visible snowmelt during the inspection. The second SWPPP was received by EPA on March 29, 2024. The March 2024 SWPPP had an updated map of the Facility and a site layout that based on EPA's observations during the inspection, accurately represented operations, storage areas and draining patterns at the Facility. The new SWPPP also included two outfalls from the Facility to the Menomonee River. The reports included visual inspections for only one outfall. The Facility has two outfalls into the Menomonee River. The reports do not include an annual check to determine whether its Facility discharges a pollutant of concern via storm water to an impaired water body listed in accordance with Section 303 (d). Section 2.8.2 of the WPDES General Permit No. WI-S067857-5 requires the results of the annual check be documented in the Annual Facility Site Compliance Inspection reports. The Menomonee River is listed as impaired with pollutants of concern listed as chlorides, phosphorus and nitrogen. The reports indicate that there are no significant changes needed to the Facility's SWPPP. However, the copy of SWPPP provided to EPA on February 23, 2024, was dated as September 2003 and it did not cover all areas of the Facility or both its outfalls to Menomonee River. SECTION VI - CLOSING CONFERENCE AND FOLLOW UP Closing Conference The EPA REGION 5 Lead Inspector held a closing conference with Facility personnel at 03:50 PM (CT) on 02/22/2024 for the inspection. During the closing conference, EPA REGION 5 Lead Inspector discussed the observations and Area(s) of Concern identified during the inspection. Observations and Area(s) of Concern have not yet been evaluated for a formal compliance determination. EPA conducted the closing conference at 3:40 pm local time. Mr. Schulz did not make a CBI claim. EPA communicated to Mr. Schulz that the inspection report will be emailed to him within 70 days of the day of the inspection. During the closing conference, EPA conveyed to Mr. Schulz the observations from the walkthrough of the Facility that included: Not having a copy of the SWPPP onsite. Stormwater catch basin sediment filters seemed packed with sediment. Used oil drums with no secondary containment next to the machine shop. Stormwater catch basin south of the showroom building did not have a sediment filter in it and had plenty of sediments in and around it. It was also situated next to a big pile of aggregates. EPA observed piles of sand and gravel on the south side of the property overflowing on the north bank of the Menomonee River. Follow Up The following items were requested by the inspector at the time of the inspection.
