(1) The OSHA regulation is listed in the Regulatory Calendar, published by the Regulatory Council, to be issued in May 197 9. Information from the Agency gives May as the earliest date. The current list of participants in the proposed court review is attached. (a) The Committee discussed the lead case and outcome of the "race" in that case. Despite the con clusion that the lead case indicates the liklihood that the litigation to review the OSHA cancer regulation will be transferred to the D.C. Circuit, the Committee was of the view that AIHC should "race" to secure priority. The estimated cost for paralegal personnel to conduct the surveillance, etc. for the race will be about $15,000. API will bear half the cost. The Committee recommended that the Steering Committee be asked to authorize an expenditure of $7,500 as AIHC's half. (b) Bob Barnard reported on discussions with counsel for the major associations on the matter of opening the record to put in some recent risk assessment documents into the record. The association counsel favor such a move. The contemplated action would be a motion to open the record to receive: The IRLG Report on Risk Assessment and AIHC's critique of the Report Part 2 of the NAS Report on Saccharin The Report of the Office of Science ahd Technology Policy entitled "Identi fication, Characterization and Control of Potential Human Carcinogens" There are several reports of the President's Regulatory Council which have been issued since the record closed which we would like to have in the record. There are papers from the Seminar on Cancer Policy (Feb. 28 - March 2) which should be included AP00052072 (8) The Committee considered the subcommittee report on the structure and operations of the Legal Committee. Scott Ferguson stated that he had asked to be replaced as chairman and proposed that action on the report be deferred until the new chairman was appointed. The Committee agreed.
