Previous Enforcement Actions: N / A III. Type and Purpose of Inspection Evaluation IV. Facility Description The facility is located at 30 Fish Road in Dudley, MA. The area the inspection was focused on consists of an approximately 10 acre clearing (Phase 2) (the " site "). Phase 1 is located south of the area we focused the inspection on and we did not inspect this area. The area we focused the inspection on is flanked on its northern and southern perimeters by two historical railroad tracks that now exist as walking rail trails. An outlet to a tributary to the Quinebaug River is located in the southeast corner of the site, downstream of a wetland / detention basin area. V. Inspection The inspection was coordinated by MassDEP who confirmed access for USEPA via an email on June 3, 2024. EPA arrived at the facility at 10am on June 4, 2024. A. Opening Conference I presented my credentials and explained the purpose of the inspection. I explained that we had received a tip over concern of potential impacts to jurisdictional wetlands and that we were here to follow up on that tip. Mr. Rebula explained that MassDEP had been out to the site the week prior, and that he would lead EPA to the areas MassDEP had concerns with. Before beginning the site walk, I asked Mr. Everton and Mr. Androlewicz to explain the activity occuring on the site. Mr. Everton explained that they work with RAMPCO to fill 2 ED_019088A_00012398-00002 the site. He explained that the site is a soil reclamation project, and they have been taking in clean fill since 2018. They eventually want to use the land for solar. B. Facility Tour We began the site walk starting along the southern border, walking southeast. We observed the first wetland area. The wetland had visible sedimentation. Mr. Androlewicz said they had regraded the area, and showed the area where the original surface was located (Photo 4). We walked along the swale, which Mr. Androlewicz informed us was dug in late 2021. There was consistent flow through the swale. We continued towards the southeast corner of the wetland complex. We observed a pool area that Mr. Androlewicz said was being used as a detention pond. The outlet area was lined with rip rap and connected directly with a stream flowing through a culvert under the rail trail. Mr. Putnam and I walked up and over the rail trail and observed a stream with defined bed and bank at the outlet of the culvert. Mr. Androlewicz and Ms. DiPinto informed us that they believe the stream on the other side of the culvert was originally a swale that was dug in the 1970's. This stream is a relatively permanent tributary of the Quinebaug River. Mr. Androlewicz also informed us that the town had replaced the culvert a few years ago. We walked back out to the area where the wetland / detention basin connects with the flowing stream through the culvert. Mr. Androlewicz and Mrs. DiPinto told EPA and MassDEP that there was originally a natural berm that prevented flow from the detention basin / wetland area to the stream. They said that MassDEP had done an inspection a few years ago indicating that this berm existed. Mr. Rebula asked for a copy of any type of record such as an email that contains this information about the berm. They said that the town replaced the culvert before they removed the berm. Continuing walking the perimeter of the site, Mr. Rebula lead the group north to follow the upstream reach of the tributary to the Quinebaug. We walked into the wooded area along the rail trail that flanks the site along the northern border. This portion of the stream reach flows through a culvert under the rail trail. I observed a wetland a stream complex on the southern side of the rail trail and noted a box culvert conveying flow dated 1914. The wetland area still had wetland delineation flags placed there by Ms. DiPinto. We exited the wooded area and continued westerly. We observed an area that originally had a wetland complex that is now filled that Mrs. DiPinto determined to be isolated when she did her wetland delineation in 2019. Mr. Rebula asked about the potential existence of a culvert up gradient of the wetland area that connected the wetland to the swale along the northern side of the rail trail. Ms. DiPinto did not recall a culvert. EPA and Mr. Rebula followed the swale upslope into the wooded area where we observed an intact flowing stream that connected into the swale. We did an auger boring near the stream, which we determined to be hydric soil. We exited the wooded area, and I asked when the armoring of the swale took place, to which Mr. Androlewicz said sometime in 2019, before they began Phase 1. 3 ED_019088A_00012398-00003 C. Closing Conference I said that EPA would follow up with an inspection report within 60 days and that we may follow up with questions in the meantime. Mr. Androlewicz and Mr. Everton requested that MassDEP and EPA review the areas they are proposing to do work so they can get back to work. We thanked everyone for their time and departed at approximately 11:30 AM. Unless otherwise noted, this report describes conditions at the facility / property as observed by EPA inspector(s), and / or through records provided to and / or information reported to EPA inspector(s) by facility representatives and as understood by the inspector(s).
