Mew Jersey Dear Sir: At its meeting in May, 195^ the Board of Health of the City of New York asked that a draft of a proposed Sanitary Code change he submitted to it in connection with paints and coatings containing excessive amounts of lead and which would indicate to the user that the material is hazardous when chewed by children. The following proposed section on this subject will be presented to the Board of Health for adoption by it as its coming meeting in September: Section of the Sanitary Code: "No person shall have, keep or offer for sale in the City of New York any liquid coating material or paint which contains lead compounds of which the lead content (calculated as Pb) is in excess of lyi of the total weight of the contained solids including pigments and dryer tinless it bears the following statement clearly and conspicu ously placed on the container or label "Yiarning: This paint contains lead - unsafe - poisonous - and should not be used to paint childrens toys or furniture or interior surfaces in dwelling units which might be chewed by children.11 Please note that there is no conflict between this proposed labeling requirement and the American Standards Association Z66.1 Subcommittee proposal, since the recommendation of this group relates to paints, which -conform to the proposed standard. The above proposed Sanitary Code labeling, you will note, only related to those paints and coatings which do not conform to the standard. Such paincs would be required to bear the Board of Health warning label. This information is sent to you in order to give you an opportunity to express your viewpoint on this proposal before it is considered by the Board of Health. .
