Dear Paul, Bruce & Steve:
As of this morning, EEI has not made a decision as to whether they will comply with our subpoena. It is our present intention to arrive at EEI's headquarters at 10:00 A.M. tomorrow to review the documents described in the subpoena, however, we do not intend to conduct a deposition at EEZ this week. If circumstances change and if we decide not to go to Washington, we will inform you promptly. Similarly, we will advise you if we ' reschedule a deposition for a later date.
