IV. Facility Description
The site comprises 9 individual Lots along Bridge Street, in Hamilton MA. At the time of
the inspection, Lots 1,3,6,7,8, and 9 were being actively worked on, each at different
phases of construction. Lots 4 and 5 are undisturbed. See attachment A for the Lot
locations and proximity to Miles River.
V. Inspection
I attempted to call Mr. Dan Bandar of Bandar Development, LLC., on 1/24/24 but could
not get through on the phone.
I then called Mr. Mark Arnold, of Goddard Consulting, who is the hired environmental
consultant to aid in stormwater erosion control implementation for some of the Lots.
Mr. Arnold said that he would meet us on Site the morning of the inspection.
I then spoke to Mr. John Murphy the morning of the inspection and he granted us
permission to go on Site.
We arrived at approximately 9:45 AM.

A. Opening Conference
Upon arrival, we met Kristan Farr and Mike Stolzfus of the Hamilton Conservation
Commission. We were also met by Mark Arnold of Goddard Consulting, Mark " Nelly "
Nalesnik of Nelly's Construction, and Dan Bandar of Bandar Development LLC. I
presented my credentials and explained the purpose of the inspection. I said we had
received some concerns over turbid stormwater discharge into the road and into the
Miles River and associated wetlands. I asked Mr. Arnold which Lots they are involved
with helping with the stormwater issues, to which he responded he is working with Lots
6,7,8, and 9. He said they have been involved since around August or September 2023.
Mr. Arnold had been formalizing reports to send to the Conservation Commission. I
asked Mr. Bandar if he could explain to me the different ownerships involved with the
different Lots. Mr. Bandar explained that he owns Lot 9 and is building a home on it for
his sister, and he sold Lot 8 to a young couple and is acting as the site super for that Lot.
Nelly's Construction was hired by Mr. Bandar to do the earth work on Lots 8 and 9 and
hired by Mr. Murphy to do the earth work on Lots 1,3,6 and 7. Mr. Bandar explained
that Gordon College is directly above the Lots, and he is working with the college to
control erosion and runoff.
B. Facility Tour
We began our site tour starting at Lot 9. I asked Mr. Bandar about the exposed steep
slopes, to which he responded he has been actively working on them. We also observed
silt fences with haybales along the bottom of the slope. We observed that the silt fences
were not dug into the ground, and informed Mr. Bandar that they needed to be dug in
to function properly. We walked to the east corner of Lot 9 and observed erosion
controls that Mr. Arnold explained were installed to mitigate the flow coming down
from Gordon College that they diverted downslope along the side of Lot 9. I also asked
about the accumulation of sediment and turbid water directly along Bridge Street
flowing downslope easterly towards a catch basin. Mr. Arnold explained that they are
going to install a rip rap swale that extends the length of the road up to Lot 8.
We then crossed the street to observe the Miles River and associated wetlands. Ms. Farr
explained that when they came out very recently they observed a lot of sedimentation
getting into the stream channel that flows into the Miles River. We observed turbid
water in this stream channel. We continued to walk along the stream channel towards
its confluence with the Miles River. Mr. Arnold explained that they did find some
sediment deposits in the wetland adjacent to the Miles River. We then walked back
towards the road, and observed another wetland area that had some sediment
deposits. Mr. Arnold said they were in there a few weeks ago removing sediment, but
we could still observe some sedimentation post clean up.
We then walked back to Lot 9 and walked upslope towards the top of Lot 9. Lot 9 does
not have a home built on it yet, but the large hole has been dug out for the area where
the house will be built. Mr. Arnold said that he plans to install a swale system to help

filter the water and divert it off the site so as to not collect dirt along the way down.
They also plan to install erosion blankets. Mr. Arnold then showed us a swale / ditch dug
by the college that was preexisting just past the tree line upslope.
We then walked along the back of Lot 9 into Lot 8. Lot 8 has an almost complete house
built on it, but still exposed earth surrounding the house. At this point, Mr. Bandar had
left the group.
We continued along the back of Lot 8 to Lot 7. Mr. Arnold explained that Mr. Murphy
had Tackifier applied to the slopes in Lot 7 to stabilize them. We observed a retention
pond downslope. Mr. Arnold said that he has not observed it breaching.
We continued walking along the back of Lot 7 and then downslope along the parcel
boundary between Lots 6 and 7. Lot 6 has a paved driveway, but exposed slopes along
the driveway. Mr. Arnold said these also have Tackifier. I observed water flowing
downslope along the driveway, and Mr. Arnold explained that there were plans to install
a check dam system.
We continued walking downslope on the driveway. I observed some sedimentation
accumulating behind the silt fences along Bridge Street. Mr. Nalesnik said they clean it
out weekly. The slopes on Lot 6 west of the driveway had visible hydroseeding.
At this point in the inspection, I explained that I wanted to observe Lots 1 and 3 as well.
Mr. Arnold said that Goddard Consulting was not directly involved with those Lots, but
he decided to accompany us on the site walk anyways. We walked along Bridge Street,
observing Lots 4 and 5 along the way. These Lots are undisturbed and in a previous
conservation with Mr. Murphy, I learned that he is unsure what his plan is with these
Lots but is waiting to do any earth work on them until the other Lots are more
complete.
The east corner of Lot 3 is where there is a break in the slope and water begins to flow
west along Bridge Street instead of east. As we walked along Bridge Street, we observed
turbid water flowing westerly. We observed a catch basin at the corner of Lot 1 on
Bridge Street that appeared to be almost at capacity. We then followed Bridge Street
further down slope towards the bridge over the Miles River, observing two additional
catch basins along the way. We walked to the bridge and observed Miles River, looking
for where there might be a possible outlet for the catch basins. We then found an area
about 10 feet off the road adjacent to Miles River on the west side of Bridge Street that
likely had a buried outlet.
C. Closing Conference
We walked back upslope towards the Lots. I told Mr. Nalesnik that I would be following
up with Mr. Bandar and Mr. Murphy with an inspection report and possible additional
